The qualities you should look for when you go to hire a personal injury law firm in south Florida

Personal Injury Law

There are many personal injury law firms located here in Jupiter, Palm Beach County, south Florida, and throughout the entire country. What you need to figure out is who are the best personal injury attorneys to handle your case and give you the best chance of getting what you think you deserve out of your case.

The first important thing for you to know: most personal injury law firms like ours at Slinkman, Slinkman & Wynne, P.A. will sit down with you and have a free initial consultation with you. So the first thing we would advise you is to cut out most if not all of the law firms who want to charge you for that initial consultation. There are enough quality firms and lawyers that will look at your case and give you an honest assessment for no charge that you need not consider paying for that meeting.

Here are some other important questions you should ask when hiring a personal injury law firm:

  • Do I have a legitimate case?
    • Practically everyone who walks into a personal injury law firm believes they have a case that could get them money… often, a lot of money. Unfortunately, this is not always the case. Be willing to listen to what feedback the lawyer is giving you. If you do not agree with the feedback, you can always go and get a second and even third opinion. But also be open to the fact that maybe you do not have as easy a case to win as you think.
  • Who will be working on my case on what are their resources?
    • Will a lawyer be working on your case, or paralegals and legal assistants? Yes, you should expect that the paralegals and assistants will do some of the work, but one of the firm’s lawyers should be involved every step of the way as well.
  • What types of cases has the firm worked in the past?
    • This is an important question as most people do not realize that there are many types of personal injury cases. Make sure to find out if the firm has a positive history in working cases in the area which your case would fall under – including Slip & Fall, accidents, malpractice, workers compensation, defective products just to name a few.
  • What is the firm’s reputation?
    • This can be found by doing some research on google. Look for industry recognition and accolades. And definitely check on their website, and through social media to view testimonials from clients and others who have worked with the firm and the attorneys in the firm.
  • How does the law firm get compensated for working your case?
    • In addition to offering a free initial consultation, The best personal injury law firms also give a “No Fee Unless We Win” guarantee. In the legal industry this is known as a “contingency fee contract.”

Arm yourself with these questions and you will give yourself the best chance at winning a personal injury lawsuit.

You often here personal injury attorneys and many other types of attorneys say that they give the best service, have the most experience, and will do what it takes to help you win your case, and get you a lot of money in the process. You can see it in the ads on television, hear it on the radio driving to and from work, or see it on the multiple billboards along I-95 that you pass on a daily basis.

But you will never see Slinkman, Slinkman & Wynne, P.A. on a television ad, or on a billboard along the highway? Why? Because we believe that our best sources for new business always come from our current and former clients. We pride ourselves on delivering on our promise – to help you get the compensation that you deserve for the injuries you have suffered: physical, mental and psychological.

While a television advertisement or a billboard may make an attorney appear knowledgeable and trustworthy, that is not always the case. Slinkman, Slinkman & Wynne has stayed away from big advertising and relies on word of mouth referrals from prior clients which is the true test of a law firm’s service to a client. Relying on referrals can only be accomplished when past clients are happy with the dedication and services provided by Slinkman, Slinkman & Wynne.

The Law Firm of Slinkman, Slinkman & Wynne, P.A. provides:

  • Contingent fee contracts – No Fees or Costs unless we prevail on your injury case.
  • Free confidential initial consultations
  • Attorneys who handle your cases…not just paralegals or support staff
  • We are proud to offer home, hospital and nursing home visits to you in the event that you are unable to meet with us in our office. Let us travel to you.

Slinkman, Slinkman & Wynne advice: what to do if your car breaks down this holiday weekend, or any other time

Broken down car

This coming weekend marks the 2nd of the three major holiday weekends of our summer season here in the United States – Independence Day. In fact, according to a recent survey by the travel organization AAA, over 44 million Americans are expected to travel this weekend, a record number for any holiday since the great recession almost a decade ago. Around 2 million of those travelers are expected to be Floridians, almost 5% of our nation’s total.

Therefore, with a number of our Jupiter, Palm Beach Gardens, West Palm Beach and Treasure Coast family and friends traveling this weekend (including a number of us here from the Slinkman, Slinkman & Wynne, P.A. law offices) we believe it is the perfect time to offer all of you some important rules for what to do if your car breaks down while you are traveling:

  • As soon as you sense there is a problem, turn on your hazard lights
  • If your car is still moving, try to steer to the right and pull over to the right shoulder as quickly but also safely as possible. If you are unable to get over to the right but there is an area available to stop your vehicle out of moving traffic in the median area, move your vehicle to that area.
  • Wherever your vehicle comes to a complete stop, fully activate your emergency brake. You want to make sure that your vehicle will not start rolling in either direction, which can happen on even a normal, almost imperceptible slope to your naked eye.
  • Call for help – if you do not know the local number for roadside assistance or for the local police, call 911.
  • Stay in your vehicle until traffic clears. For example, if the worst happens and your vehicle stalls on the highway in traffic, do not leave your vehicle until help arrives, no matter how long it takes.
  • Once you are able to exit your vehicle safely (if you are) pop your hood and leave it open to signal other drivers that your vehicle is broken down.
  • DO NOT try to make any repairs or checking under your car if you are on the side of busy roadway or still in the line of traffic. People have been seriously injured and even killed in such situations.
  • If you can, put out some type of flares or other safety devices that behind your vehicle that signal you are in distress and can not move. Put one about 10 feet behind the vehicle, and another about 200 feet behind.
  • Once you have done these things, walk as far away from oncoming traffic as possible to wait for help to come.

At Slinkman, Slinkman, & Wynne we strongly believe in sharing any information that can help prevent tragedy from happening – like these tips for what you should do if your car breaks down this Independence Day holiday weekend. Slinkman, Slinkman & Wynne, P.A. safety – tips to keep you safe while operating or riding upon a motorcycle

Motorcycle riding on the open road

Summer is here – for motorcycle riders, that means heading out on the open road to quench their thirst for the excitement and freedom that comes along with driving their motorcycles. At Slinkman, Slinkman & Wynne, P.A. we understand the lure of motorcycles for those who love them. We also realize that motorcycle driving can be very dangerous, particularly on the crowded highways here in south Florida.

With that in mind, we offer a list of tips for safe motorcycle driving and riding:

  1. Drive defensively
    1. Bad automobile drivers cause accidents with motorcycles; but so too do bad motorcycle drivers themselves. Aggressively operating a motorcycle causes a significant number of motorcycle accidents, as well.
  2. Do NOT drink and operate or ride on a motorcycle
    1. In a study cited in an article on motorcyclecruiser.com, the California Highway Patrol found that 69 percent of all at-fault motorcycle collisions happened when the rider was “under the influence” of drugs or alcohol.
  3. Follow the rules of the road
    1. Piggybacking on tip #2, following the rules of the road gives you a much better chance of getting back home safe and sound.
  4. Consistently check your motorcycle, particularly after longer rides, to make sure it is in proper working condition.
  5. If you have not done so already, take a motorcycle safety course.
  6. Both driver and rider should wear well-made protective helmets.
    1. Yes, we realize that here in Florida by law you can operate or ride on a motorcycle without a helmet or protective headgear. However, we have seen the results of what riding without a helmet can do in an accident. A helmet can save you from severe brain damage and even death. It is your head, your brain and your life – protect it.
  7. You should also wear protective clothing.
    1. Protective clothing can significantly lessen the damage to your body, particularly to your skin.
  8. Stay out of the blind spots of automobile and truck drivers
    1. The biggest problem with weaving in and out of traffic when you are operating your motorcycle is that invariably you end up crossing into and out of blind spots. As a result you significantly raise the chance that someone will accidently move into your path from another lane.
  9. Always be aware of road hazards and obstructions

Follow up to last week’s blog re: the growing incidence and danger of prescription drugs causing DUI

Prescription drug bottles

In our last blog we discussed the growing epidemic of DUI (Driving Under the Influence of a controlled substance) related arrests here in south Florida and throughout our country being caused by prescription drugs. The Tiger Woods DUI case has shown a spotlight on a problem that law enforcement has become all-too familiar with in recent years: prescription drugs are often powerful, and can become just as dangerous as alcohol when a person uses them and then gets behind the wheel of their motor vehicle.

In fact, taking a prescription drug before driving can be even more dangerous than alcohol because the danger of mixing prescription drugs and motor vehicle operation has been much less discussed and spotlighted than its counterpart alcohol. Furthermore, as The Palm Beach Post writers Jorge Millan and John Pacenti highlighted in their article on this very subject in last Thursday’s edition of The Palm Beach Post:

“According to a 2015 study released by the Governors Highway Safety Association, about 43 percent of fatally injured drivers were found to have either prescription or illegal drugs in their system, compared with 37 percent of drivers who had consumed alcohol. In 2005, only 27 percent of fatally injured drivers showed evidence of drug use.

The American Automobile Association reports that “prescription drugs are the most prevalent of all drugs” found in fatally injured drivers (46.5 percent).”

Millan and Pacenti further pointed out that the danger of driving under the influence of prescription drugs is even more pronounced because many drivers are “unaware they are doing anything wrong by driving drugged.”

As we stated in last week’s blog and as you see discussed clearly in this and many other articles, an impaired person is held responsible for all damages incurred in an accident, even if under the influence of prescription drugs and not alcohol or hard drugs. That is obvious to most people. Fewer people realize that in this scenario you may also be considered a victim of a criminal act under our state law.

If you or a person you care about gets injured in a vehicle accident caused by a driver under the influence or you simply have a question about a potential personal injury situation that you have not yet had answered, please call us at Slinkman, Slinkman & Wynne, P.A. We offer a free initial consultation, and our phone number is (561) 686-3400.

Prescription drug abuse continues to lead to more DUI arrests in Jupiter and throughout Florida

DUI - prescription drug automobile accident deaths

By now almost everyone in south Florida and throughout the rest of the country has heard about Tiger Woods’ DUI arrest here in Jupiter early Monday morning. As more details have come out about the arrest, one of Tiger’s own statements that has received attention has been his contention that he was actually not under the influence of alcohol, but of a combination of prescription drugs.

When most of us think of DUI – Driving Under the Influence, we think of alcohol, hard core drugs like cocaine. The truth is that prescription drugs make up a significant portion of DUI arrests. Although the exact percentages are not known due to a lack of specific statistics, a 2010 study showed that prescription drugs were the 2nd most abused drug before driving when a fatal accident was involved. Only marijuana usage was higher on that list, while driving under the influence of cocaine caused only 25% of the number of automobile accident fatalities as prescription drugs, according to that same study.

To read about that study, go to: http://www.recoveryfirst.org/dui-drugged-driving/

Prescription drug abuse has become a serious problem in the United States. Numerous studies, stories and articles have highlighted the fact that pain clinics (sometimes referred to as “pill mills”) right here in Florida are helping to fuel the growth in this abuse problem.

Here is one of those many articles on this topic: http://www.courier-journal.com/story/news/local/2016/08/25/florida-fuels-prescription-drug-abuse-epidemic-archive/89299090/

In the state of Florida, the term DUI in our statutes encompasses significantly more than just alcohol, or even alcohol and hard-core drugs. Prescription drug use and abuse is involved in a significant amount of the motor vehicle accidents on our roadways and waterways – and you need a law firm well-versed in the laws of our state to help you get the compensation you deserve if you are involved in an accident caused by someone who is impaired by prescription drugs, or other drugs or alcohol in the state of Florida.

Just as with alcohol, that impaired person is held responsible for all damages incurred in the accident, even if under the influence of prescription drugs. That is obvious to most people. Fewer people realize that in this scenario you may also be considered a victim of a criminal act under our state law.

Memorial Day weekend: a fun-filled weekend, but also the most deadly of driving holidays

Memorial Day weekend 2017

Memorial Day weekend 2017 is here! This coming weekend marks so many good things to all of us Americans – the unofficial beginning to summer, the end of the school year, and the fun and great food of backyard and beach BBQ’s with family and friends. In addition, it is a time to honor those men and women who sacrificed their lives serving in the U.S. military to preserve the freedoms we enjoy in this country today.

Unfortunately, this weekend also holds one very dubious title: it is the most dangerous driving weekend of the year. According to the National Highway Traffic Safety Administration (NHTSA) More people are killed in motor vehicle accidents over the 3-day Memorial weekend here in Florida and around the United States, on average, than any other 3-day period on the calendar. That includes the 4th of July, Labor Day, Thanksgiving, Christmas and New Year’s weekends.

Most recent statistics derived from this article: https://www.valuepenguin.com/most-dangerous-holidays-drive

At Slinkman, Slinkman & Wynne, P.A. we value the health and well-being of all of you – our neighbors, friends and family here in Jupiter, Florida, and every town and city throughout this great country of ours. Starting today, be willing to go that extra step that may save your own life, or the lives of people you love.

Do not get behind the wheel of an automobile while impaired. In addition, if you are driving, put down your cell phone. If current trends continue, texting and other distracted driving will soon catch and may well surpass drunk driving as the leading single cause of automobile accidents causing serious injury and wrongful death in the United States. If you are one of the guilty parties who do it – Stop It. Stop it Now! If not for yourself, then do it for all those other lives you could have a devastating effect on if you cause an accident.

In addition, if you see someone who is impaired and about to start driving a vehicle – whether it be an automobile, a truck, a boat or a motorcycle – stop them. If you are sober, offer to drive them home, or at least call them a cab or an Uber. You may be saving their lives, and the lives of others on the road. At the very least you could be saving them from the pain, stress and significant expense of a DUI.

Stay safe this Memorial Day weekend – we want to see all of you healthy and happy next week, and far into the future!

If you or someone you know is injured or dies as a result of an auto accident caused by a drunk driver, a distracted driver or someone else’s negligence of any type, please contact us at Slinkman, Slinkman & Wynne, P.A. immediately. Motorcycle accidents hurt and kill thousands of people in Florida every year

Motorcycle accident picture

The reports come in all-too-frequently here in Jupiter, Palm Beach Gardens, West Palm Beach, Stuart and practically every city and town throughout south Florida and beyond:

Earlier this very evening: “One person is injured after a crash involving a motorcycle and a truck near Loxahatchee Tuesday evening, according to Palm Beach County Fire Rescue.

First responders were called to the intersection of Northlake Boulevard and Hall Boulevard, just east of Seminole Pratt Whitney Road, where a motorcycle and a truck collided after 9 p.m. The crash caused a fire on at least one of the vehicles and one person was injured, according to fire rescue.

The unidentified person was flown by the the Trauma Hawk to a local hospital. The person’s condition is unknown at this time. It’s unclear if anyone else was injured in the crash.”

And this afternoon: “WEST PALM BEACH, FL (WFLX)  Palm Beach County Fire Rescue is on the scene of a fatal motorcycle accident near Military Trail and Okeechobee Blvd. in West Palm Beach.

According to Palm Beach County Fire Rescue PIO Capt. Don Delucia, one person has died.

The intersection is currently shut down and drivers are being diverted from the area.”

http://www.wflx.com/story/15886031/fatal-motorcycle-accident

And just this past Sunday: “Two motorcyclists from Palm Beach County died Sunday afternoon after their motorcycle hit a truck.

The accident occurred on Southeast Dixie Highway at Southeast Winged Foot Drive, according to the Florida Highway Patrol.

Scot Brian Fertig, 58, of West Palm Beach, was southbound at 2:20 p.m. on Southeast Dixie Highway when he crossed into northbound traffic, hitting the front end of a Toyota Tundra truck driven by Jonathan Rivera, 22, of Hobe Sound.

Fertig and a passenger on the motorcycle, Dianne Denise Resinkoff, 42, of Lake Worth, both were pronounced dead at the scene.

Neither motorcyclist was wearing a helmet.”

http://www.treasurecoast.com/two-dead-in-motorcycle-accident/

Unfortunately, if you are involved in a motorcycle accident, there is a good chance you will suffer significant injury, and possibly even die. According to statistics compiled by state and federal highway authorities, Florida continues to lead nation in motorcycle accidents on a yearly basis. In fact, almost 1 in 10 of the almost 5,000 fatalities from motorcycle accidents in the entire United States occur right here in Florida. On top of that, almost 10,000 were injured – many seriously – in our state alone.

At, Slinkman, Slinkman & Wynne P.A. we have over four decades of experience working with clients who have been involved in motorcycle accidents causing serious injury and death. We strongly believe in helping to promote motorcycle safety in our communities here in Jupiter, Palm Beach Gardens, West Palm Beach, Stuart as well as throughout the state of Florida.

If you or anyone you know has been injured in a motorcycle accident, our Palm Beach Gardens Injury Attorneys are here to help.  The reality is…if you’re a Florida biker living in the Palm Beaches, it’s not a matter of if you’ll be involved in an accident, but most likely when. That’s where we come in.
