Drinking and Driving – a bad and potentially very costly decision in Florida

Drinking is a rite of passage that comes about for most Americans once they hit the golden age of 21. The problem with this rite of passage, however, is that many are inexperienced with drinking and, in turn, let loose behind the wheel of a car with alcohol in their system as soon as they are legal.  Florida has one of the highest rates of drivers arrested for driving under the influence of alcohol.  While the public’s perception is that a majority of drunk drivers on the roads are in their teens or 20s, in our practice the victims who have been injured by drunk drivers have mostly been injured by middle aged male drunk drivers.  Recently our firm represented a client who was severely injured when a middle aged male drunk driver attempted to make a left turn failing to yield to oncoming traffic and in doing so slammed into the side of our client’s car.

The drunk driver who t-boned our client was arrested near the scene of the crash.  The drunk driver’s blood alcohol level was a .32, over four times the legal limit!  The drunk driver was so intoxicated that he attempted to flee the scene, luckily for our client a good samaritan followed him.  When the police arrived at the drunk driver’s vehicle and removed him from the car he was so drunk that he defecated in his pants! This crash caused significant injuries to our client’s neck and back for which one day she will likely require at least one spinal surgery.  Our client’s ability to enjoy life on a daily basis was affected by this drunk driver’s failure to use a designated driver, taxi, Uber or some other form of transportation to get home that night.

Unfortunately for us South Florida residents this is a risk we live with on a daily basis.  Please remember to drive safe and always be on the lookout for erratic drivers, especially at nights and on the weekends.  While you can’t stop a stranger from drinking and driving you can possibly avoid a dangerous situation by being alert.  Also, if you notice a vehicle making erratic movements please contact the local police and report it; this simple task could save lives.

The aforementioned incident, not isolated in any regard, should serve as a warning to all drivers who make the choice to drink and drive, in addition to everyone else driving out on the roads. If you choose to drink and drive, you risk not only your own life, but the lives of others. It also serves as a warning to all motorists to be vigilant when driving because other drivers can be the real danger to you and your family’s safety. The lawsuit was settled with an undisclosed amount going to our client.
