Slinkman, Slinkman & Wynne, P.A. school driving safety tips, part 2 – dropping off children at school

School drop off - car cutting drop off line

At Slinkman, Slinkman & Wynne, P.A. we believe that if we help one person avoid a potentially dangerous situation that leads to an injury or their death. That is why we dedicate many of our blog posts and articles to sharing information that helps you and your loved ones to be safe and hopefully stay healthy. In the next several blog posts we offer “back to school driving safety tips”. Important tips to help you share the road safely with other cars, pedestrians, school buses and bicyclists.

In this post we offer tips on do’s and don’ts of what to do if you are dropping off children at school here in Jupiter, Palm Beach Gardens, West Palm Beach or anywhere else in a community where schools and/or children reside.

When you are dropping off children at school:

  • Carpool wherever possible
    • Carpooling reduces congestion and helps reduce pollution.
  • Do not drop your children off across the street from the school
    • Yes, it takes a few extra minutes to get in line and drop off in front of the school. It also saves your children from crossing a very busy, potentially dangerous street.
  • Do not double park
    • This raises congestion and causes potentially dangerous blind spots. It also raises everyone’s frustration level, just like the next point.
  • Do not cut the line
    • Every car in front of you is waiting to pick up their child just like you. The more respectful everyone is, the quicker each person moves through, picks up their child/children, and completes the process.
  • Try to stay off your mobile devices, if possible.
    • Particularly if you are moving. Children can be unpredictable, and one can come jumping out from the sidewalk or from behind a vehicle in a split second without notice. If you are distracted, if even for a moment, it can change that other person’s life, forever. And, your own.

We acknowledge using and sharing this important information with you from the National Safety Council. To read their entire article dedicated to back to school safety, please go to: http://www.nsc.org/learn/safety-knowledge/Pages/back-to-school-safety-tips-for-drivers.aspx

Resources that may help you save a teenager from a devastating distracted driving accident from Slinkman, Slinkman & Wynne

Summer has long been known as a time when automobile accidents involving teenage drivers increase. Teenagers are on summer break from either high school or college, so they tend to be out on the roadways more, and more often at night, then during the rest of the year.

Unfortunately, the problem with teenage driver accidents has been exacerbated with the introduction of cell phones and other devices into the mix. Distracted driving has led to a significant increase in accidents, injuries and deaths for all driver, but particularly those in the 15 to 20 age group. In previous blogs we discussed the statistics compiled by the National Safety Council, AAA and other organizations dedicated to stemming the tide of teenager distracted driving accidents, injuries and deaths.

And just last year the AAA Foundation for Traffic Safety concluded an extensive study of recorded data from the last six seconds before 1,700 crashes found an astonishing 58% of “moderate to severe teen crashes” are the result of the driver being distracted. At Slinkman, Slinkman & Wynne, P.A. we believe there has to be a concerted effort by all Americans to help all drivers understand the risk of distracted driving – with an even larger focused message to teenage drivers.

To that end, we are providing links to several more websites that offer support and information to teenage drivers, their families and anyone else who is interested in combating this problem that has led to so much needless pain and suffering of those who have been involved in distracted driver accidents:

and a local non-profit organization dedicated to the cause of traffic safety, particularly amongst teens:

We will continue to share information and stories related to this extremely important topic. At Slinkman, Slinkman & Wynne we believe if we can help save one life, stop one accident, it will be more than worth it.

Boating and Jet skiing accidents increase in Florida in 2015

Jet skiing is one of the most popular shoreline activities to do here in Florida. Flying along across the waves can be incredibly fun and exhilarating – and also quite dangerous. The uneven, rocky shoreline in many areas, combined with our notorious rip currents (currents that flow away from shore) can cause problems for even the most experienced of jet skiers in our area.

This now-famous video posted on YouTube captures a jet ski crash that occurred along the Newport Beach, California coastline in June. Although this happened in California, jet ski accidents like this can and do happen here in Florida, as well.

In fact, according to the Florida Fish and Wildlife Conservation Commission,  Florida had 737 boating accidents in total in 2015, which includes jet ski and wave runner accidents. That is 103 more accidents as compared to 2014, however, there was a 25 percent decrease in fatalities. A total of 55 people lost their lives last year in boating accidents.

How to spot a drunk driver in Jupiter and Palm Beach Gardens

Summer is here which also means the summer driving season is here. Many families pack up their belongings and the children and head to points all over the United States to visit friends and relatives. Of course there are also 3 major holidays that happen during this time, as well. Memorial Day has come and gone, while Independence Day is only a few weeks away with Labor Day to follow at the beginning of September.

Statistics tell us that the incidence of drunk driving rises significantly on and around these holidays. In fact, July 4th and Labor Day turn out to be two of the three or four days with the most drunk driving deaths in America every year, according to yearly surveys by the National Highway Traffic Safety Administration (NHTSA).

With that in mind here are ways for you to spot a drunk driver out on the road during this time, and any time. Spotting a drunk driver in enough time to get away may just save your life, and the life of your family.

From MADD: “While we work hard to turn cars into the cure and eliminate drunk driving forever, families must continue to be vigilant on our roadways.  You can help protect your family from drunk drivers by looking for these signs of intoxication among other motorists.” This full list is shared directly from the Mothers Against Drunk Driving (MADD) website:

  1. Quick acceleration or deceleration
  2. Tailgating
  3. Weaving or zig-zagging across the road
  4. Driving anywhere other than on a road designated for vehicles
  5. Almost striking an object, curb, or vehicle
  6. Stopping without cause or erratic braking
  7. Drifting in and out of traffic lanes
  8. Signaling that is inconsistent with driving actions
  9. Slow response to traffic signals (e.g. sudden stop or delayed start)
  10. Straddling the center lane marker
  11. Driving with headlights off at night
  12. Swerving
  13. Driving slower than 10 mph below the speed limit
  14. Turning abruptly or illegally
  15. Driving into opposing traffic on the wrong side of the road

Steps you need to take if you are involved in a Slip & Fall accident

Wet Floor Warning

“Slip & Fall” accidents happen every day, particularly afflicting the elderly and others who have a hard time moving around. But it can happen to you, as well. Do you know what to do if you are a loved one gets hurt in a Slip & fall accident?

If you are involved in a slip/trip & fall accident, you should:

  • Avoid making any detailed statements concerning fault. Saying the wrong thing, or just saying too much can and will be used against you in court.
  • Make sure to get names of owners and managers of the property
  • Write down the names of witnesses; try to get their phone numbers as well.
  • If you are not incapacitated by your injuries, take good pictures of the scene and of your injuries.
  • Save the footwear and clothing you were wearing at the time of the accident.
  • Seek medical attention if injured immediately. If not immediately, then at least within 14 days, as required by current Florida Statute. Otherwise, you will not be able to seek full compensation for future medical bills, and it may cost you other compensation as well.

And

  • Do not give recorded statements to any insurance adjusters. Period. Even your own.

The liability of a premises owner or operator depends on the state and federal laws that apply to the circumstances. For example, an owner of a home or public store has a duty to warn you about any known hazards that you might encounter. Construction workers are legally obligated to warn and protect the public from hazard at their work sites. Depending on individual circumstances, all may still be liable for injuries you receive while on their premises, even if they warned you of potential injury.

Texting & Driving: a preventable cause of too many deaths and injuries on Florida roadways

Stop Texting While Driving Sign

The time has come. In fact, it has long since passed. And now we have another year’s worth of statistical data that shows beyond a shadow of a doubt that we need more of a deterrent to stop texting and driving – and most other forms of cellphone usage while operating a motor vehicle.

In the state of Florida in 2015 alone 214 people were killed in accidents caused by “distracted driving.” An astounding 39,396… yes, over 39,000! Were injured. We ask every single citizen of this state – when is enough enough? How many more lives need to be lost or forever changed for the negative because of someone else’s negligence?

The fact is that our states’ laws against texting and driving, and cellphone usage while driving in general are some of the most lax in the entire country. For example, texting while driving is still considered a “secondary” offense here in Florida. A secondary offense means that you must get pulled over for committing some other offense before you get cited for texting while driving as well.

How many more lives will be lost needlessly and carelessly before we as a state get serious about curbing “distracted driving”? Our drinking and driving laws have become significantly more costly – in both money and freedoms taken away – than they were just a few short years ago. The same needs to happen with Florida’s texting and driving laws, as well.

Here are several websites we have mentioned before, such as http://www.textinganddrivingsafety.com/ and https://noys.org/ to see what you can do to help spread the word on curtailing texting and driving with teenage drivers, and all other drivers.

If you are injured in an auto accident because the other driver was texting, you may have a right to bring a claim for various damages and injuries incurred. Call us at Slinkman, Slinkman & Wynne, P.A. We offer a free initial consultation, and our phone number is (561) 686-3400.

At Slinkman, Slinkman, & Wynne, we know that automobile accidents involving cell phone usage happen all the time now, unfortunately. If you are in an accident because of the willful negligence of another driver then you need to contact us right away. We help our clients obtain payment to cover hospital and other medical expenses, pain and suffering, and more, if the situation warrants it.

If you want to learn more about how we can help you in a situation where someone you love has been in an auto accident, then go to this page on our website: http://www.sswlawfl.com/areas-of-practice/auto-accident/. Yes, you only have a limited time to bring a Defective Products lawsuit in Florida

Defective Products - kids equipment

People do get hurt every day while using the machines, appliances, equipment and even toys that assist us as we live our lives on a daily basis. Sometimes these injuries are 100% due to user error, or alterations made to the products leading to accidents because of improper usage. Unfortunately, this is not always the case. Sometimes, a defective product is partially or fully to blame for you or your loved one getting injured, or even dying.

The law of product liability is the area of law that deals with the liability of the manufacturer, wholesaler or retailer of a product for injuries resulting from that product. This includes the manufacturer of component parts of the product, an assembling manufacturer, the wholesaler, the retail store or other ultimate seller of the product, and any other party in the distributive chain, regardless of whether you actually purchased the item yourself.

One of the most important aspects of product liability cases is the statute of limitations as stated in Title VIII, Chapter 95 of the 2015 Florida Statutes. Contained within the list of 17 different actionable events described under the FOUR YEARS Section of Chapter 95.11 are the following two items:

  • An action founded on negligence.

and

  • An action for injury to a person founded on the design, manufacture, distribution, or sale of personal property that is not permanently incorporated in an improvement to real property, including fixtures.

Go here to read the entire Chapter 95.11 (Section 11) of the 2015 Florida Statutes: http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&Search_String=&URL=0000-0099/0095/Sections/0095.11.html

This means according to the most recent Florida Statutes you have up to FOUR YEARS to file most defective product claims.  This may seem like a long time, but four years can go by in a blink of an eye; particularly if you or a loved one has suffered significant injuries or even death from a defective product or some other type of manufacturer or retailer negligence.

Instead of trying to figure out how to get some type of settlement out of the manufacturer or their high-powered, expensive lawyers who are paid to keep as much money from you as possible, come to Slinkman, Slinkman & Wynne, P.A. We are a law firm who has well over four decades of experience helping our clients receive the maximum amount of compensation they deserve for injuries, medical bills, lost wages and pain and suffering due to defective products.

At Slinkman, Slinkman, & Wynne, P.A., we know that any product may cause injury or death. Even if the defect is not due to any negligence on the part of the manufacturer, the manufacturer can be held responsible for any damage caused by the defective product. The retailer may also be viewed are partially responsible for having canned and sold the defective product. A claim can even be brought against the person or company that was involved in producing or distributing the defective product.

If you want to learn more about how to go about hiring the right attorneys for you in a situation where you have been injured by a defective product, then go to http://sswlawfl.com/areas-of-practice/defective-products/. We also specialize in Accident & Serious Injury, Wrongful Death, Medical Malpractice, Auto Accidents, Motorcycle Accidents, Boating Accidents and many other types of legal situations where injury or death has occurred.
