Sobering news: NSC announces that automobile deaths in first half of 2016 increase 43% in state of Florida

car crash accident on street, damaged automobiles after collisio

In its semi-annual report released recently, the National Safety Council announced that distractions while driving combined with lower once again were the leading causes in another significant rise in fatal auto accidents throughout the United States in the first six months of 2016. In the report, the National Safety Council said that approximately 19,100 motor vehicle deaths occurred from January through June of this year – an increase of 9% from the same period in 2015. That also puts the U.S. on pace to have more than 40,000 automobile accident fatalities by the end of the year; the first time we have exceeded that number since 2007.

Even worse for us Floridians, that same report also stated that driving-related deaths in Florida were up a whopping 43% over last year. This jump comes on the back of significant increases in both 2015 and 2014. Florida was one of only three states to have more than 1,000 deaths in the first half of the year, and has the 5th largest increase of any state in the country. Only Vermont, Oregon New Hampshire and Idaho have seen a higher rate of increase in the death rate.

As quoted in an article in the Insurance Journal, “Our complacency is killing us,” said Deborah A.P. Hersman, president and CEO of the National Safety Council (NSC). “One hundred deaths every day should outrage us. Americans should demand change to prioritize safety actions and protect ourselves from one of the leading causes of preventable death.”

Slinkman, Slinkman & Wynne safety tips: driving during school days in Florida

school bus unloading

The middle of August here in Florida means several things: the summer season weather-wise (hot and humid) is about half over, but more importantly, schools are back in full swing. Even if you do not have any children that are school-age, you know school is back in session with the significant pick up in traffic and congestion on the roadways as you try to make your way to and from work. That also means you must be significantly more careful where ever you are driving at this time of year.

Therefore, we will do a 2-part blog on driver safety during school days. This first part is a refresher of general driving safety tips for all drivers at this time of year to help keep kids, other drivers and yourself accident and injury-free during school days. In the second part we will share with you some safety tips for parents and others driving kids to and from school:

  • Plan to leave your home a few minutes earlier than you did during the summer to get to your destination.
    • Between school buses, kids walking and on bikes, and parents trying to drop off or pick up their kids, traffic congestion is significantly more than it was just two weeks ago. Adjust for that so you keep yourself from getting frustrated, angry and impatient behind the wheel.
  • Slow down and pay attention to the road AND the surrounding sidewalks
    • Even the safest of drivers can not predict a child darting out into the middle of the road apparently out of nowhere. The slower you are driving, the more time you will have to react when unexpected, potentially dangerous actions by others, particularly kids, happen.
  • Do NOT pass a bus that has its “Stop Sign” and blinkers on. Ever.
    • Of course we all have had that morning we are running late, and then we get stuck behind a school bus stopped to pick up kids… and it is taking forever. There is no one on the other side of the road, and it looks so tempting to go around the bus and continue on your way. Don’t do it. The leading cause of death among kids and teenagers is accidents/unintentional death, according to https://medlineplus.gov/ency/article/001915.htm

Texting & Driving: a preventable cause of too many deaths and injuries on Florida roadways

Stop Texting While Driving Sign

The time has come. In fact, it has long since passed. And now we have another year’s worth of statistical data that shows beyond a shadow of a doubt that we need more of a deterrent to stop texting and driving – and most other forms of cellphone usage while operating a motor vehicle.

In the state of Florida in 2015 alone 214 people were killed in accidents caused by “distracted driving.” An astounding 39,396… yes, over 39,000! Were injured. We ask every single citizen of this state – when is enough enough? How many more lives need to be lost or forever changed for the negative because of someone else’s negligence?

The fact is that our states’ laws against texting and driving, and cellphone usage while driving in general are some of the most lax in the entire country. For example, texting while driving is still considered a “secondary” offense here in Florida. A secondary offense means that you must get pulled over for committing some other offense before you get cited for texting while driving as well.

How many more lives will be lost needlessly and carelessly before we as a state get serious about curbing “distracted driving”? Our drinking and driving laws have become significantly more costly – in both money and freedoms taken away – than they were just a few short years ago. The same needs to happen with Florida’s texting and driving laws, as well.

Here are several websites we have mentioned before, such as http://www.textinganddrivingsafety.com/ and https://noys.org/ to see what you can do to help spread the word on curtailing texting and driving with teenage drivers, and all other drivers.

If you are injured in an auto accident because the other driver was texting, you may have a right to bring a claim for various damages and injuries incurred. Call us at Slinkman, Slinkman & Wynne, P.A. We offer a free initial consultation, and our phone number is (561) 686-3400.

At Slinkman, Slinkman, & Wynne, we know that automobile accidents involving cell phone usage happen all the time now, unfortunately. If you are in an accident because of the willful negligence of another driver then you need to contact us right away. We help our clients obtain payment to cover hospital and other medical expenses, pain and suffering, and more, if the situation warrants it.

Required personal injury protection benefits in Florida – what they mean to you as a Florida resident

Personal Injury Claim

Most people who live here in Florida are aware that the state has a series of laws called the Florida Statutes that are “a permanent collection of state laws organized by subject area into a code made up of titles, chapters, parts, and sections. The Florida Statutes are updated annually by laws that create, amend, transfer, or repeal statutory material.”

http://www.leg.state.fl.us/Statutes/index.cfm?Mode=View%20Statutes&Submenu=1&Tab=statutes

Included amongst the 2015 Florida Statutes is an entire section on Insurance: Title XXXVII, Chapters 624 through 651. Chapter 627 of this section covers Insurance Rates and Contracts. 627.736 refers to “Required personal injury protection benefits; exclusions; priority; claims”

At Slinkman, Slinkman & Wynne, P.A. we realize that most Florida residents reading this blog do not want to read through the rather complicated and long-winded statutes that discuss insurance requirements. You want to know what they are and how they affect you and your loved ones, in plain English.

Since the last changes to the statutes in 2012 & 2013, Florida drivers have been required to carry the following minimum insurances:

  • $10,000 in personal injury protection (PIP) benefits, and
  • $10,000 in property damage liability (PDL) benefits.

Florida does not, however, require drivers to have bodily injury liability (BIL) benefits (which pay the costs of others’ injuries if a crash occurs). Most other states do require you to have BIL benefits in your insurance coverage. All auto insurance policies must be purchased from insurers licensed to do business in Florida. Driving without insurance in Florida is illegal, and a driver may have his or her license suspended if caught driving without at least the minimum required insurance. To get a license reinstated, a driver has to show proof of insurance on every vehicle owned in the state of Florida, and must pay a fine of up to $500 per violation.

These are just the basic rules of insurance as they are presently constituted here in Florida. Our Board Certified lawyers from Slinkman, Slinkman, & Wynne are the right lawyers to get you the best settlement that you deserve based upon your unique set of circumstances when you have been involved in an automobile accident.  We will find out what coverage you and all of the motorists involved in the accident have – making sure to ask all of the right questions of all companies and interested parties in your case.

If a person you care about gets hurt or killed in a car, motorcycle or boating accident, or you simply have a question about a potential personal injury situation that you have not yet had answered, please call us at Slinkman, Slinkman & Wynne, P.A. At Slinkman, Slinkman, & Wynne, we understand that motor vehicle accidents happen every day. We also understand that not everyone has the minimum insurance coverage required under the current state statutes.

Should I hire a lawyer if I have been in an auto accident in Jupiter or Palm Beach Gardens? How to decide

Car Crash

“Do I really need to hire a lawyer if I have been in an automobile accident?”

At Slinkman, Slinkman & Wynne, P.A. we have been asked this question asked many times. Our answer is almost always “Yes”. But is that because we are attorneys ourselves, so we are obviously biased? Although it would seem that way, we actually feel this way for some fundamentally sound reasons that become more obvious as you read this article.

Let’s start at the beginning – when the car accident actually happens. As soon as the trauma and adrenaline of the accident starts to wear off, you have a lot on your mind – and that is true even if you have not suffered significant injuries. In addition to your injuries you have to deal with the emotional stress and turmoil; the damage to your vehicle; the handling of your claim(s) with the insurance companies and/or a court of law; and many other issues depending upon your particular situation.

Lawyers like those at our highly experienced law firm can help you deal with many of your post-accident issues. Therefore, we offer you the following information from the website www.dmv.org to help you determine whether hiring an attorney is the right choice for you:

“Property Damage

One of the biggest losses after an accident is the loss of property. Your vehicle may be heavily damaged and, in some cases, be considered a total loss.

It’s typically the car insurance company’s prerogative to either:

  • Deem your car a total loss.
    OR
  • Pay for repairs.

First, you’ll need to determine whether your coverage will pay or whether the other company will pay. For instance:

  • If you are at fault, you’ll seek reimbursement through your own policy.
  • If you are not at fault, you’ll generally seek payment through the other insurer.
  • In some cases (e.g., if you live in a no-fault state, or you were in a hit and run), you may seek compensation from your own car insurance company.

Regardless of the company from which you’re seeking payment, you might find their initial claim offer is insufficient to fully cover your repair or replacement costs.

If you don’t have the energy or knowledge to pursue a more substantial claim, you need the services of an attorney to ensure you get what you deserve.

Personal Injury

If you are injured as a result of an accident, you need to get the proper medical care right away. If you delay, it can be harder to prove your injuries resulted from the car accident. In addition, in the state of Florida, if you do not go to a doctor within 14 days after the accident, you will most likely not get compensated for your injuries – even if they do not start to affect you until after the 14 days have passed.

Your payment for care will depend on the coverages in your policy. If you are not at fault, your bills will be paid for by the other driver’s liability coverage. If you live in a no-fault state, however, you can seek payment from your personal injury protection (PIP) coverage to get your bills without the delay of negotiation between companies.

You can also seek payment from:

When You Need a Personal Injury Attorney

As you seek reimbursement, remember that it’s extremely common to get pushback on these expenses. Insruance companies try to avoid paying more than they need to and will check to make sure all the expenses are valid. Keep all of your documentation and receipts. If you continue to have trouble getting your medical bills paid, seek the counsel of a personal injury attorney.

Attorneys have experience working with insurance providers to get the highest possible settlement amounts for clients.

They also have experience getting compensation for general damages that are difficult to determine, such as:

  • Pain and suffering.
  • Mental anguish.

For example, if you’ve lost your vision due to an accident resulting from another driver’s negligence, a personal injury lawyer can help you get general damages in addition to the actual costs of your medical bills.

Statute of Limitations

If you have been injured or you have lost any type of personal or business property due to an accident, don’t wait to get the help you need and deserve.

You have only a short amount of time under local, state, and federal law to file your claim and protect your rights. This time limit is called the statute of limitations, and varies by state.

If you feel you need an attorney to navigate your claim, contact one without delay.

Having the help of an experienced attorney can leave you free to concentrate on healing and moving on with your life.”

Slinkman, Slinkman & Wynne continues to successfully help clients in Jupiter, Palm Beach Gardens and others in Florida

We have spent much space and numerous articles on this blog discussing the different types of personal injury cases that we accept at Slinkman, Slinkman & Wynne, P.A. We have not spent any time discussing actual cases we have been involved in and financial awards we have won or settled for our clients. Part of the reason is that we do have guidelines on what we can say as set forth by the Florida Bar Association. More importantly, at our law firm we believe in the sanctity of privacy.

At Slinkman, Slinkman & Wynne we work very hard for our clients. For over 40 years we have prided ourselves on word of mouth referrals from former clients, other lawyers and doctors as our chief form of referrals. Over the last 4 decades our work and our results have helped us to build up an extensive network of referral partners in the areas of Jupiter, Palm Beach Gardens, Tequesta and Stuart in Florida.

Our cases have ranged from negligence, to product defect, to slip and fall, to premises liability to insurance litigation to medical malpractice to civil rights violations. We have extensive experience working with members of our community who are fighting against much larger entities and need an expert on their side to have a fair chance to get the compensation they deserve. To see a summary of some of the notable cases we have been involved in, please go to  http://www.sswlawfl.com/cases-judgments/.

The common threads connecting each case and each of our clients is that we bring knowledge, expertise and Board-Certified Trial lawyers that you do not often get with a locally-based firm. Our clients also receive a hands-on attention to detail from our lawyers (and not just our assistants and paralegals) that you do not often get with bigger firms.

If you are in a case involving negligence of some type that caused you or someone you love injury or death – an automobile, motorcycle or boating accident; or a Slip and Fall accident, Wrongful Death & Serious Injury situation, Medical Malpractice, Defective Products, or many other types of legal situations where injury or death has occurred anywhere in Florida, contact us immediately.

What to do and not to do if you are involved in a hit-and-run auto accident in Jupiter or Palm Beach Gardens

People often ask us for tips on how to best handle situations in the aftermath of different types of accidents and mishaps. One of the most common questions we get asked about is what to do after you have been involved in a hit-and-run accident where the other person hit you and took off before you could get the license plate number.

Hit-and-run accident victims often will panic or get very angry – understandable immediate responses, but in either case letting their emotions get the better of them. Their emotions then cloud their judgement as to what are appropriate vs. inappropriate courses of actions to take at that critical time.

As with any accident, you must thoroughly document the hit and run accident for both the police and your insurance company. So you must get control of your emotions so that you can rationally replay the accident in your mind, from beginning to end. Of course it becomes a lot harder to do when the other driver has left the scene – and left you to deal with the aftermath alone.

Here is a step-by-step guide of what you should do if you are ever the victim of a hit-and-run accident in Jupiter, Palm Beach Gardens, or anywhere else in Florida:

  • Get as much information as possible, including:
    • The time, location, description and cause of the accident
    • The license plate number, if possible
    • The other vehicle’s make, model and color – if you noticed anything unique about the vehicle, make sure to note that, as well
    • Photos of all of the damage to your car
    • Description of damage to the other vehicle, as accurately and as thoroughly as possible
    • Which direction the other car was headed – both at the time of the accident, and which direction it took off in
    • If anyone witnessed the accident and is still present, ask them if they can provide additional information and/or a statement – for both you and the police. Be sure to get their names and contact information.

… and here are two things NOT TO DO:

  • DO NOT try to follow the other driver. Obviously this could put you in a compromising and potentially dangerous situation if you ever catch the person. Just as importantly, it can cause the police to question who was at fault.
    • In addition, you will most likely miss out on getting any eyewitness accounts to support your story
  • DO NOT wait to call either the police or your insurance company to report the accident, and then to make a claim. Call both immediately! The police accident report will not only help you when you make your accident claim with your insurance company, but it can also help the police in finding the person who caused the accident.
