    • In Missouri Johnson & Johnson was ordered to pay $200 million for talcum powder products that allegedly caused ovarian cancer when used for feminine hygiene. J&J is fighting the ruling and looking to move the case to New Jersey.

Automobile accidents in U.S. in 2016 rise to their highest level since in 2007: 2-year increase most in over 50 years

Different year, even worse results. Sadly.

 

In its annual report released last week, the National Safety Council announced that lower gas prices and distractions while driving (texting and drunk driving chief among them) helped lead to another significant rise in fatal auto accidents throughout the United States in 2016.

 

In the report released last Wednesday, the National Safety Council said that approximately 40,200 motor vehicle deaths occurred from January through December of 2016 – an increase of 6% from the same period in 2015, and 14% over the two years since 2014, the largest 2-year jump in over 50 years.

 

As we here at Slinkman, Slinkman & Wynne, P.A. we have been saying for over 40 years, even one death from an automobile accident is too many. Unfortunately, too many of our fellow Floridians and Americans just do not seem to be getting message – stop texting while driving, and using drugs or alcohol before getting behind the wheel of an automobile. As Deborah A.P. Hersman, president and CEO of the National Safety Council asked in her statement, “Why are we ok with this?”

Safety advocates point to the continuing rise in the number of deaths as a percentage of miles driven as proof that distracted driving – particularly texting and drug and alcohol use – as proof that too many people take the danger of driving for granted.

What effect could President Trump Supreme Court Justice appointment have on personal injury cases in Florida?

As President Donald Trump heads into his second official week in office he is already having a significant impact on a broad spectrum of areas both inside and outside of America. His executive orders have put a freeze on civilian federal government hiring, pulled America out of the Trans-Pacific Partnership trade agreement, threatened “Sanctuary Cities” with reduced funding, called for the construction of a physical wall along the U.S.-Mexico border and put a temporary ban on immigration to the U.S. from seven predominantly Muslim countries.

 

On tap for this week is the first action our new President will take that could have a significant and direct effect on future personal injury cases and awards. This coming Thursday, February 2nd, President Trump will officially nominate a judge to replace the late Justice Antonin Scalia on the Supreme Court.

 

According to most Supreme Court experts, this first appointment may not alter the balance of the court from when Justice Scalia was alive, no matter how conservative the appointee may be. What they do point to, however, is if our new President is able to appoint a second or third justice during his term. At that point, according to John J. How do you go about picking a personal injury attorney when you need one? Suffice it to say – the multiple debates accomplished nothing other than to make me extremely frustrated. Particularly since I have been a loyal customer for all of those 25 years, involved in only one accident since my early college days. Conservatively they have made at least $20,000 on me over that time.

 

When I related my story to Slinkman, Slinkman & Wynne, P.A. partner Ryan Wynne at a networking event, he asked me if I were willing to allow him to work on my behalf to try and recover some of the money I had lost. Honestly, I had given up. After hours of useless arguing with multiple insurance company representatives on the telephone, I figured that Ryan and his firm had zero chance of getting me another penny. Sobering news: NSC announces that automobile deaths in first half of 2016 increase 43% in state of Florida

In its semi-annual report released recently, the National Safety Council announced that distractions while driving combined with lower once again were the leading causes in another significant rise in fatal auto accidents throughout the United States in the first six months of 2016. In the report, the National Safety Council said that approximately 19,100 motor vehicle deaths occurred from January through June of this year – an increase of 9% from the same period in 2015. That also puts the U.S. on pace to have more than 40,000 automobile accident fatalities by the end of the year; the first time we have exceeded that number since 2007.

Even worse for us Floridians, that same report also stated that driving-related deaths in Florida were up a whopping 43% over last year. This jump comes on the back of significant increases in both 2015 and 2014. Florida was one of only three states to have more than 1,000 deaths in the first half of the year, and has the 5th largest increase of any state in the country. Only Vermont, Oregon New Hampshire and Idaho have seen a higher rate of increase in the death rate.

As quoted in an article in the Insurance Journal, “Our complacency is killing us,” said Deborah A.P. Hersman, president and CEO of the National Safety Council (NSC). “One hundred deaths every day should outrage us. Americans should demand change to prioritize safety actions and protect ourselves from one of the leading causes of preventable death.”

All of us at Slinkman, Slinkman & Wynne, P.A. offer our prayers to everyone in our home state of Florida, along with all of the people in Georgia, South Carolina, North Carolina and Viriginia who were affected by Hurricane Matthew last week. We were particularly saddened to hear of the 34 people (as of earlier today) who lost their lives, and the devastating flooding that continues in North Carolina. Not to mention the mass suffering in Haiti, Cuba and the Bahamas.

On the defective product legal front, the serious problem that Samsung has had with their release of the Android Galaxy Note 7 smartphones went to another level of ugliness when it was revealed over the last 24 to 48 hours that Samsung has been forced to recall all of the replacement smartphones they sent out to customers and their entire supply chain to replace the over 2.5 million defective units originally sent out in August and September. Apparently, the replacement smartphones that were deemed “Safe” by Samsung are also now being recalled.

Here is Samsung’s latest statement, released yesterday, according to numerous sources, including arstechnica.com:

“We are working with relevant regulatory bodies to investigate the recently reported cases involving the Galaxy Note 7. Because consumers’ safety remains our top priority, Samsung will ask all carrier and retail partners globally to stop sales and exchanges of the Galaxy Note 7 while the investigation is taking place.

We remain committed to working diligently with appropriate regulatory authorities to take all necessary steps to resolve the situation. Consumers with either an original Galaxy Note 7 or replacement Galaxy Note 7 device should power down and stop using the device and take advantage of the remedies available.”

The bottom line for anyone who has a Samsung Galaxy Note 7 in your possession, even if it is one of the replacement units – your smartphone is unsafe. Return it, now… and as the old saying goes “Do not pass Go; do not collect $200.”

Within the last 2 months Samsung has been forced to recall the same new product twice – and with this 2nd recall they have widened the scope to every single unit that has been sent out. The first recall in September excluded Note 7’s that were supposedly designed differently and sent to other countries, including China. This time, there are no exclusions.

As writer Ron Amadeo states in the arstechnica.com article, this very well could mean the end of the Samsung Galaxy Note 7. This entire situation is a disaster for Samsung and its OEM partners of epic proportions – and that is even before the dozens if not hundreds of lawsuits that will surely be directed their way over the coming months and years.

The Samsung Galaxy Note 7 – the utter disaster that a defective can be for a company
