Defective products – a look back at the biggest cases of 2016 that affected south Florida families

defective-products-picture

Every year there are people here in south Florida and throughout the nation who are either injured or killed by defective products. Many of those people and their loved ones are unsure of where they can turn for help. At Slinkman, Slinkman & Wynne, P.A. one of the areas of personal injury law that we specialize in is defective products. We have been able to get our clients millions of dollars in settlements and judgements in our over 40 years in practice in cases involving defective products.

We believe it is also important to share with all Jupiter, Palm Beach Gardens, West Palm Beach, Stuart and other south Florida families information that can help you to learn if you may be the victim of a defective product. One of the best resources for information on defective products is http://www.usrecallnews.com.

This site recently posted an article on the “Worst Defective Products” of 2016, highlighting 3 defective products in particular. Unfortunately, in each case people have been killed by the defective products. You may have heard about one or more of these cases in the news or read about it on the internet:

  • Takata Air Bags
    • When Takata’s air bags deploy they allegedly explode, sending shrapnel in all directions in the inside of your vehicle. 11 people have been killed and over 100 injured. According to the National Highway Traffic Administration (NHTSA) this is the largest recall of vehicle airbags ever.
  • GM ignition switch litigation
    • At least 124 deaths and 274 injuries linked to defective ignition switches. GM has paid out approximately $2 billion so far, with more lawsuits that could add another $7 billion to $10 billion in settlements by the time all the cases are settled.
  • Talcum Powder from Johnson & Johnson
    • In Missouri Johnson & Johnson was ordered to pay $200 million for talcum powder products that allegedly caused ovarian cancer when used for feminine hygiene. J&J is fighting the ruling and looking to move the case to New Jersey.

Automobile accidents in U.S. in 2016 rise to their highest level since in 2007: 2-year increase most in over 50 years

national-safety-council-logo

Different year, even worse results. Sadly.

In its annual report released last week, the National Safety Council announced that lower gas prices and distractions while driving (texting and drunk driving chief among them) helped lead to another significant rise in fatal auto accidents throughout the United States in 2016.

In the report released last Wednesday, the National Safety Council said that approximately 40,200 motor vehicle deaths occurred from January through December of 2016 – an increase of 6% from the same period in 2015, and 14% over the two years since 2014, the largest 2-year jump in over 50 years.

As we here at Slinkman, Slinkman & Wynne, P.A. we have been saying for over 40 years, even one death from an automobile accident is too many. Unfortunately, too many of our fellow Floridians and Americans just do not seem to be getting message – stop texting while driving, and using drugs or alcohol before getting behind the wheel of an automobile. You are putting your own life, and the lives of everyone around you in serious danger.

As Deborah A.P. Hersman, president and CEO of the National Safety Council asked in her statement, “Why are we ok with this?”

“Complacency is killing us.”

Safety advocates point to the continuing rise in the number of deaths as a percentage of miles driven as proof that distracted driving – particularly texting and drug and alcohol use – as proof that too many people take the danger of driving for granted.

What effect could President Trump Supreme Court Justice appointment have on personal injury cases in Florida?

how-a-judge-becomes-a-supreme-court-justice

As President Donald Trump heads into his second official week in office he is already having a significant impact on a broad spectrum of areas both inside and outside of America. His executive orders have put a freeze on civilian federal government hiring, pulled America out of the Trans-Pacific Partnership trade agreement, threatened “Sanctuary Cities” with reduced funding, called for the construction of a physical wall along the U.S.-Mexico border and put a temporary ban on immigration to the U.S. from seven predominantly Muslim countries.

On tap for this week is the first action our new President will take that could have a significant and direct effect on future personal injury cases and awards. This coming Thursday, February 2nd, President Trump will officially nominate a judge to replace the late Justice Antonin Scalia on the Supreme Court.

According to most Supreme Court experts, this first appointment may not alter the balance of the court from when Justice Scalia was alive, no matter how conservative the appointee may be. What they do point to, however, is if our new President is able to appoint a second or third justice during his term. At that point, according to John J. Bursch of Bursch Law PLLC, who has argued before the Supreme Court on many occasions, “dramatic change is possible.” http://howardandhoward.com/user_area/uploads/MLW%20-%20Howard-TE%201-12-17.pdf

Due to the age of two current Supreme Court Justices, Justice Ruth Bader Ginsburg (84 years old) and Supreme Court Justice Anthony Kennedy (80 years old), President Trump getting that chance is a distinct possibility. And if that does indeed happen, then Mr. Bursch sees significant changes that could come in a whole variety of court precedents, including class-action litigation.

And according to University of Detroit Mercy Law School Professor Lawrence A. Dubin, ““In an effort to cut costs, further limits might be imposed on personal injury, wrongful death and medical malpractice claims.”

That would mean a significant negative effect on you if you are trying to receive fair compensation when you have been injured or killed in a severe accident or due to medical or someone else’s willful negligence. Continue to follow our blog to stay up-to-date on tort law reform that may effect you or a loved one in a personal injury case.

At Slinkman, Slinkman, & Wynne, P.A. we realize that a change of several Supreme Court justices during President Trump’s term in office could have a negative effect on the rights of injured people. We help our clients obtain payment to cover hospital and other medical expenses, pain and suffering, and more, if the situation warrants it. How long do I have to file a personal injury lawsuit in the state of Florida?

a-statute-of-limitation

Like every other state in America, Florida has a law in its statutes that specifically sets a deadline for the amount of time you have to file a lawsuit in our state’s civil courts against the person or business that might be legally at fault for your injuries caused in an accident. This law is called a statute of limitations, and in Florida law this statute can be found in the Florida Statutes Annotated section 95.11.

The most important aspect of the statute of limitations for you if you are injured in an accident is that it gives you four (4) years from the date of the accident to file a lawsuit. Otherwise, unless under extreme and very rare cases, the court will almost certainly refuse to even hear your case at all.

One important adjunct to the Florida statute of limitations law is that if your injury claims are against either a city, county or state government entity or official your time limit to file is only three (3) years.

What the “Cases & Judgments” page on our Slinkman, Slinkman & Wynne website means to you as a potential client of our law firm

slinkman-slinkman-wynne-logo

As we leave 2016 behind and look forward into 2017 we want to wish everyone a very Happy New Year and much prosperity in the new year and every year that follows. At Slinkman, Slinkman & Wynne we will continue our cause of fighting for the individuals and families of south Florida, as we have for over 40 years.

We offer a “Cases and Judgments” page on our website so that any potential client can get an idea of a few of the notable cases we have worked on in our past – and success we have had helping Floridians who have been seriously injured or wrongfully killed arising from cases of severe accidents, medical negligence, owner negligence, or defective products.

This page is not meant to pat ourselves on the back. We believe that in order for people in need of a personal injury lawyer’s services to make the best decision they should know what qualifies us to help them receive the best settlement possible.

As we have noted in previous blogs, there are a number of sources that you should check before making the important decision of which personal injury attorney that you should hire to handle your case. The criteria you should use for making that choice should include:

  • Ask friends, family and associates.
  • Call your state bar association.
  • Check with a lawyer referral service.
  • In states like Florida that allow lawyers to advertise, you may find one through an ad, HOWEVER, ALWAYS Interview more than one lawyer before deciding who will represent you.
  • *** Try to find out what previous experience and results the attorney and law firm have had on cases like yours.
    • This last one is the reason we offer a summary of some of the cases we have successfully handled on behalf of our clients.

In addition, be aware that most personal injury attorneys offer a free initial consultation. If the one you call first does not, move on. At the initial consultation:

  • Discuss all fees and costs at your initial consultation.
  • Get any details in writing before you make a commitment.
  • Choose a lawyer with whom you feel comfortable discussing your case and with whom you can be honest, AND the firm that will ask all of the right questions; not just of you, but also of the legal firm on the other side and the insurance companies involved.

Our Board Certified lawyers from Slinkman, Slinkman, & Wynne are the right lawyers to get you the best settlement that you deserve based upon your unique set of circumstances.  We make sure to ask the right questions of all companies and interested parties in your case. We represent clients anywhere in the state of Florida.

If a person you care about gets hurt or killed in a car motorcycle or boating accident, or you simply have a question about a potential personal injury situation that you have not yet had answered, please call us at Slinkman, Slinkman & Wynne, P.A. Slinkman, Slinkman & Wynne: what our membership in the Million Dollar Advocates Forum® means to you

million-dollar-advocates-logo

At Slinkman, Slinkman & Wynne, P.A. we realize that most of our neighbors here in Jupiter, Palm Beach Gardens, West Palm Beach and the Treasure Coast of Florida go through life hoping they never need the services of a personal injury law firm like ours. Honestly, we wish that for all of you as well.

The fact is; the average automobile driver will be in between 3 and 4 accidents during your life, according to recent car insurance industry estimates as stated in this Forbes magazine article. http://www.forbes.com/sites/moneybuilder/2011/07/27/how-many-times-will-you-crash-your-car/#1e1ddcb050f9. A sobering statistic for all American drivers, to be sure.

Although not all of those automobile accidents require the use of a personal injury attorney, some of them obviously do. So how do you find the best law firm to represent you in your case when you need one?

One way is to find attorneys who have distinguished their ability to be successful enough for their clients to belong to a group that less than 1% of all personal injury law firms across the United States are a part of. In the case of personal injury attorneys, that select group is called the “Million Dollar Advocates Forum®”.

The Million Dollar Advocates Forum limits its membership to only those personal injury lawyers who have demonstrated “their ability to accomplish superior results in complex cases.”

As stated on the forum’s website: “Established in 1993, the Million Dollar Advocates Forum (which includes the Multi-Million Dollar Advocates Forum) is one of the most prestigious groups of trial lawyers in the United States.  Membership is limited to attorneys who have won million and multi-million dollar verdicts and settlements. There are over 4000 members throughout the country.  Fewer than 1% of U.S. lawyers are members.

The quality of our membership is very impressive and includes many of the top trial lawyers in the country. Many of our members have achieved numerous million and multi-million dollar results (several members have won billion dollar cases). Their practice areas include most areas of litigation, including: major personal injury, products liability, malpractice, construction, environmental, employment, insurance and business litigation. The common fact is that they have each demonstrated, in an objective and tangible way, their ability to accomplish superior results in complex cases. Certification by the Million Dollar Advocates Forum provides recognition of such accomplishment and a national network of experienced colleagues for information exchange, assistance and professional referral.

Since 1993 membership has been based upon strict objective qualifications.”

Slinkman, Slinkman & Wynne – a real automobile accident story from one of our clients

slinkman-slinkman-wynne-logo

How do you go about picking a personal injury attorney when you need one? So many of us are afraid that after you get past the television commercials and the hype, most personal injury law firms are little more than uncaring “ambulance chasers”, just looking for their next big score, whether or not you have a legitimate personal injury case or not.

Here is a story that proves beyond a shadow of a doubt that attorneys and staff at Slinkman, Slinkman & Wynne, P.A. are not your typical personal injury law firm personnel. Their practice is made up of people who really do care about their clients – and they really do go the extra mile to try and get you the compensation you deserve for the losses that you suffered.

How do I know this? Because I have been a client of theirs. During the late afternoon/early evening of a Monday in April of last year (2015), I was involved in 2-car automobile accident on I-95 in West Palm Beach. Luckily, neither I nor the people in the other car involved suffered any type of serious injury. My car, however, was deemed a total loss by my insurance company.

During the weeks that ensued I would come to learn that my automobile insurance company of 25 years valued my car at almost $5,500 less than I owed on my loan (despite the fact I purchased it used, two years old), AND they would only cover 5% of the cost of my visit to my local MDNow to have my neck checked out – an additional loss of $525 for me. Since I had only owned the car for 10 months, I argued with my insurance company that they had covered the car for the full value of what I purchased it for, and I could not understand how they now valued it for $8,000 less than my purchase amount in less than a year.

Suffice it to say – the multiple debates accomplished nothing other than to make me extremely frustrated. Particularly since I have been a loyal customer for all of those 25 years, involved in only one accident since my early college days. Conservatively they have made at least $20,000 on me over that time.

When I related my story to Slinkman, Slinkman & Wynne, P.A. partner Ryan Wynne at a networking event, he asked me if I were willing to allow him to work on my behalf to try and recover some of the money I had lost. Honestly, I had given up. After hours of useless arguing with multiple insurance company representatives on the telephone, I figured that Ryan and his firm had zero chance of getting me another penny. But hey, since he was willing, why not let him try?

Well, it took about 9 months of effort by Ryan and his team – yes, he did not give up fighting for me, even after I had said to him that he could give up at least 2 or 3 times. And amazingly, Ryan Wynne and his team was able to get the insurance company to agree on a settlement that netted me a payment of around $3,300.

I realize that does not sound like a lot of money. But for me, that $3,300 was totally found money – from the same insurance company that told me, in essence, to go pound sand. That surprise and welcome settlement helped me to pay off the rest of my car loan.

Therefore, if you are like so many other people, and you have no idea how to go about finding a personal injury law firm you can trust will work hard for you when you have been injured – then take it from me, and my personal experience. If you are located in Jupiter, Palm Beach Gardens, West Palm Beach, Stuart or anywhere else in south Florida, then Slinkman, Slinkman & Wynne is the personal injury attorney firm that will get you every penny that you deserve from your case – even if you are sure, like I was, that your insurance company or the party who caused your injury will never have to give you a penny. The lawyers at this firm understand personal injury law thoroughly, are hard-working, and willing to fight for you.

Go to our “Cases and Judgments” page to learn more about the many cases we have won fighting for our clients in a variety of personal injury cases, including automobile accidents, defective products, slip and fall, medical malpractice and others: http://www.sswlawfl.com/cases-judgments/.

At Slinkman, Slinkman & Wynne, P.A. we have practiced law in Jupiter, Florida, Palm Beach County, and the Treasure Coast since the early 1970’s. During that time we have been devoted to protecting South Florida families for over 40 years.

We limit our practice to serious injury and wrongful death arising out of severe accidents and medical negligence. Those areas of personal injury law we focus on include automobile accidents, boating accidents, motorcycle accidents, defective products and medical malpractice. We look forward to meeting you and fulfilling the needs of you and your family.
