Memorial Day weekend: a fun-filled weekend, but also the most deadly of driving holidays

Memorial Day weekend 2017

Memorial Day weekend 2017 is here! This coming weekend marks so many good things to all of us Americans – the unofficial beginning to summer, the end of the school year, and the fun and great food of backyard and beach BBQ’s with family and friends. In addition, it is a time to honor those men and women who sacrificed their lives serving in the U.S. military to preserve the freedoms we enjoy in this country today.

Unfortunately, this weekend also holds one very dubious title: it is the most dangerous driving weekend of the year. According to the National Highway Traffic Safety Administration (NHTSA) More people are killed in motor vehicle accidents over the 3-day Memorial weekend here in Florida and around the United States, on average, than any other 3-day period on the calendar. That includes the 4th of July, Labor Day, Thanksgiving, Christmas and New Year’s weekends.

At Slinkman, Slinkman & Wynne, P.A. we value the health and well-being of all of you – our neighbors, friends and family here in Jupiter, Florida, and every town and city throughout this great country of ours. Starting today, be willing to go that extra step that may save your own life, or the lives of people you love.

Do not get behind the wheel of an automobile while impaired. In addition, if you are driving, put down your cell phone. If current trends continue, texting and other distracted driving will soon catch and may well surpass drunk driving as the leading single cause of automobile accidents causing serious injury and wrongful death in the United States. If you are one of the guilty parties who do it – Stop It. Stop it Now! If not for yourself, then do it for all those other lives you could have a devastating effect on if you cause an accident.

In addition, if you see someone who is impaired and about to start driving a vehicle – whether it be an automobile, a truck, a boat or a motorcycle – stop them. If you are sober, offer to drive them home, or at least call them a cab or an Uber. You may be saving their lives, and the lives of others on the road. At the very least you could be saving them from the pain, stress and significant expense of a DUI.

Stay safe this Memorial Day weekend – we want to see all of you healthy and happy next week, and far into the future!

Happy St. Patrick’s Day – have fun, but please be careful and do not drink and drive

St. Patrick's Day

Today is St. Patrick’s Day – a day of fun, good food and reverie. We all have the chance to be Irish on this day, whether our ancestors are from the Emerald Island or not.

Unfortunately, St. Patrick’s Day also ranks among the most popular days of the year for Americans consuming large amounts of alcohol. According to the yearly statistics published on WalletHub, St. Patrick’s Day ranks as the 4th most popular drinking day in the United States; only surpassed by Christmas, Independence Day and New Year’s Eve.

According to the website’s findings, 30 people were killed in drunk driving accidents over the St. Patrick’s Day holiday period in 2015. And a whopping 75% of automobile accidents on the average St. Patrick’s Day involve a driver who has consumed at least 2 times the legal alcohol limit. You can check out all of the interesting statistics that Wallethub compiled this year here:

And in another recent St. Patrick’s Day article related to too much drinking, more people tend to binge drink over this period than usual, which leads to an increased rate of DUI and death from alcohol poisoning.

How to spot a drunk driver in Jupiter and Palm Beach Gardens

Summer is here which also means the summer driving season is here. Many families pack up their belongings and the children and head to points all over the United States to visit friends and relatives. Of course there are also 3 major holidays that happen during this time, as well. Memorial Day has come and gone, while Independence Day is only a few weeks away with Labor Day to follow at the beginning of September.

Statistics tell us that the incidence of drunk driving rises significantly on and around these holidays. In fact, July 4th and Labor Day turn out to be two of the three or four days with the most drunk driving deaths in America every year, according to yearly surveys by the National Highway Traffic Safety Administration (NHTSA).

With that in mind here are ways for you to spot a drunk driver out on the road during this time, and any time. Spotting a drunk driver in enough time to get away may just save your life, and the life of your family.

From MADD: “While we work hard to turn cars into the cure and eliminate drunk driving forever, families must continue to be vigilant on our roadways.  You can help protect your family from drunk drivers by looking for these signs of intoxication among other motorists.” This full list is shared directly from the Mothers Against Drunk Driving (MADD) website:

  1. Quick acceleration or deceleration
  2. Tailgating
  3. Weaving or zig-zagging across the road
  4. Driving anywhere other than on a road designated for vehicles
  5. Almost striking an object, curb, or vehicle
  6. Stopping without cause or erratic braking
  7. Drifting in and out of traffic lanes
  8. Signaling that is inconsistent with driving actions
  9. Slow response to traffic signals (e.g. sudden stop or delayed start)
  10. Straddling the center lane marker
  11. Driving with headlights off at night
  12. Swerving
  13. Driving slower than 10 mph below the speed limit
  14. Turning abruptly or illegally
  15. Driving into opposing traffic on the wrong side of the road

Why you need a lawyer if you are the victim of a car accident caused by a drunk driver in Jupiter, Florida

With the holiday season upon us comes lots of food, fun, good cheer – and many opportunities for drinking, partying and driving. Unfortunately, there are some people who drink too much. Accidents that involve drinking and driving spike at this time of year, according to the National Highway Traffic Safety Administration (NHTSA). In fact, the number of fatalities rises 25% on an average day during the holiday season, and as much as 50% over the New Year’s holiday.

If you are involved in an accident caused by someone who is impaired by drugs or alcohol in the state of Florida that person is held responsible for all damages incurred. That is obvious to most people. Fewer people realize that in this scenario they are also considered a victim of a criminal act under our state law.

Obviously, drunk drivers are responsible for all damages incurred when they cause an accident. In addition, since Florida does not require mandatory insurance for car owners, there may be another defendant that you can recover money and damages from. Who is that? The person or restaurant who served the drinker the alcohol, that’s who.

According to Florida Statute 768.125 “Liability for injury or damage resulting from intoxication.—A person who sells or furnishes alcoholic beverages to a person of lawful drinking age shall not thereby become liable for injury or damage caused by or resulting from the intoxication of such person, except that a person who willfully and unlawfully sells or furnishes alcoholic beverages to a person who is not of lawful drinking age or who knowingly serves a person habitually addicted to the use of any or all alcoholic beverages may become liable for injury or damage caused by or resulting from the intoxication of such minor or person.” – http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&Search_String=&URL=0700-0799/0768/Sections/0768.125.html

It is usually simple proving a defendant served alcohol to a minor.  However, it often takes a lot more work to prove a defendant served alcohol to a habitual drunk.  Several of the points you must prove are:

  • how long the person has had an alcohol problem
  • the frequency of their drinking
  • how often the person frequents the establishment
  • how much contact and their behavior with the employees of the establishment that night, and before
  • what was the person’s specific behavior and alcohol consumption on the night of the incident.

These are just a few of the important questions that your attorney must get answers to for you to have a chance at winning a case against the person or establishment that served the drunk driver. You need to hire a law firm with lawyers who have the experience and knowledge combined with the dogged determination to get all the information to help you win your case.

If you or a person you care about gets injured in an accident caused by a drunk driver or you simply have a question about a potential personal injury situation that you have not yet had answered, call us now at Slinkman, Slinkman & Wynne, P.A. We offer a free initial consultation, and our phone number is (561) 686-3400.
