Slinkman, Slinkman & Wynne, P.A. safety – tips to keep you safe while operating or riding upon a motorcycle

Motorcycle riding on the open road

Summer is here – for motorcycle riders, that means heading out on the open road to quench their thirst for the excitement and freedom that comes along with driving their motorcycles. At Slinkman, Slinkman & Wynne, P.A. we understand the lure of motorcycles for those who love them. We also realize that motorcycle driving can be very dangerous, particularly on the crowded highways here in south Florida.

With that in mind, we offer a list of tips for safe motorcycle driving and riding:

  1. Drive defensively
    1. Bad automobile drivers cause accidents with motorcycles; but so too do bad motorcycle drivers themselves. Aggressively operating a motorcycle causes a significant number of motorcycle accidents, as well.
  2. Do NOT drink and operate or ride on a motorcycle
    1. In a study cited in an article on motorcyclecruiser.com, the California Highway Patrol found that 69 percent of all at-fault motorcycle collisions happened when the rider was “under the influence” of drugs or alcohol.
  3. Follow the rules of the road
    1. Piggybacking on tip #2, following the rules of the road gives you a much better chance of getting back home safe and sound.
  4. Consistently check your motorcycle, particularly after longer rides, to make sure it is in proper working condition.
  5. If you have not done so already, take a motorcycle safety course.
  6. Both driver and rider should wear well-made protective helmets.
    1. Yes, we realize that here in Florida by law you can operate or ride on a motorcycle without a helmet or protective headgear. However, we have seen the results of what riding without a helmet can do in an accident. A helmet can save you from severe brain damage and even death. It is your head, your brain and your life – protect it.
  7. You should also wear protective clothing.
    1. Protective clothing can significantly lessen the damage to your body, particularly to your skin.
  8. Stay out of the blind spots of automobile and truck drivers
    1. The biggest problem with weaving in and out of traffic when you are operating your motorcycle is that invariably you end up crossing into and out of blind spots. As a result you significantly raise the chance that someone will accidently move into your path from another lane.
  9. Always be aware of road hazards and obstructions

Knowing your rights in Florida from Slinkman, Slinkman & Wynne, P.A.: if you are injured by a defective product in Florida, you only have 4 years to file suit

Defective Products - kids equipment

You see them in the news every day. Injuries and death caused by defective products. The fact is, injuries from defective products occur every day in the state of Florida. Manufacturers with even the best reputations and history of producing safe products can on occasion produce a defective product that ends up hurting someone.

Today, maybe that person will be you or someone you love. When a person’s injury is caused directly by a defective product, it is understandable that the aggrieved person wants to be compensated by the manufacturer whose product caused their pain and suffering.

As with most states, the state of Florida has specific laws which govern the amount of time that an injured party has to file a lawsuit against the product’s producer. In Florida this set of laws are known as the Florida statute of limitations. Specifically, defective products are covered under section 95.11, “Limitations other than for the recovery of real property.” Part of the intent of this section is to distinguish between property damage and injury done to a person.

This section of the state of Florida Statutes is listed here: http://codes.findlaw.com/fl/title-viii-limitations/fl-st-sect-95-11.html

A person who is injured by a defective product is usually allowed to sue either the manufacturer, seller and/or designer of the product, depending upon the circumstances of the case. The important aspect of the statute of limitations to you, if you are the injured party, is that you have a time limit of 4 years from the last day it can be determined you were injured by the defective product.

If you wait beyond the 4 years to file a claim, your case will most likely be dismissed, even if you have a legitimate case. Therefore, it is important for you as the aggrieved party to keep track and maintain proper records of when the defective product caused your injury. And then it is important to follow through, contact an experienced, knowledgeable law firm with attorneys like the ours at Slinkman, Slinkman & Wynne, P.A. who have successfully litigated and won settlements for other people who have been injured by defective products. Do not wait until it is too late!

Study of NHTSA data reveals that more fatal accidents occur today than any other day during month of April

Tax day cartoon - tax day 2017

saved from yesemails.com

Today is income tax filing day here in Jupiter, Florida and throughout the United States. In other words, most people’s least favorite day of the year. An interesting study which looked at data compiled by the National Highway Traffic Safety Administration (NHTSA) gave us all another reason to not like tax day – more fatal automobile accidents occur on this day than any other day during the entire month of April.

The study, conducted and published by researchers at the University of Toronto, found that over a 30 year span, the “car accident death rate” was in fact 6% higher on tax day over any other April day. Several experts quoted in an April 30, 2015 article published in The Legal Examiner (a Central Pennsylvania Legal Newsletter) offered four reasons why the fatal accident rate goes up on this day:

  1. There are more motorists on the road on tax day than on the average day in April.
  2. More drivers are forced to drive off of their “regular route” to get to the post office or their accountant’s office to get their taxes filed on time on this day.
  3. More drivers driving “recklessly” to get to the post office to meet today’s deadline.
  4. More drivers are driving distracted due to the stress caused by having to file their taxes today.

To read this entire article, go to: http://central-pennsylvania.legalexaminer.com/automobile-accidents/study-suggests-car-accidents-increase-on-tax-day/

Whatever the reasons are, today is statistically the most dangerous day to be driving out on the roads of Florida, and practically everywhere else in America.

If you are injured in an auto accident because the other driver was distracted by the stress of tax day, or they were texting while driving, or by any form of distraction including drugs or alcohol, you may have the right to bring a claim for various damages, injuries incurred and all other incidental costs you incur. Contact us at Slinkman, Slinkman & Wynne, P.A. and find out all of your options from the law firm that has been protecting the rights of south Florida families for over 40 years!

Slinkman, Slinkman & Wynne – a real automobile accident story from one of our clients

slinkman-slinkman-wynne-logo

How do you go about picking a personal injury attorney when you need one? So many of us are afraid that after you get past the television commercials and the hype, most personal injury law firms are little more than uncaring “ambulance chasers”, just looking for their next big score, whether or not you have a legitimate personal injury case or not.

Here is a story that proves beyond a shadow of a doubt that attorneys and staff at Slinkman, Slinkman & Wynne, P.A. are not your typical personal injury law firm personnel. Their practice is made up of people who really do care about their clients – and they really do go the extra mile to try and get you the compensation you deserve for the losses that you suffered.

How do I know this? Because I have been a client of theirs. During the late afternoon/early evening of a Monday in April of last year (2015), I was involved in 2-car automobile accident on I-95 in West Palm Beach. Luckily, neither I nor the people in the other car involved suffered any type of serious injury. My car, however, was deemed a total loss by my insurance company.

During the weeks that ensued I would come to learn that my automobile insurance company of 25 years valued my car at almost $5,500 less than I owed on my loan (despite the fact I purchased it used, two years old), AND they would only cover 5% of the cost of my visit to my local MDNow to have my neck checked out – an additional loss of $525 for me. Since I had only owned the car for 10 months, I argued with my insurance company that they had covered the car for the full value of what I purchased it for, and I could not understand how they now valued it for $8,000 less than my purchase amount in less than a year.

Suffice it to say – the multiple debates accomplished nothing other than to make me extremely frustrated. Particularly since I have been a loyal customer for all of those 25 years, involved in only one accident since my early college days. Conservatively they have made at least $20,000 on me over that time.

When I related my story to Slinkman, Slinkman & Wynne, P.A. partner Ryan Wynne at a networking event, he asked me if I were willing to allow him to work on my behalf to try and recover some of the money I had lost. Honestly, I had given up. After hours of useless arguing with multiple insurance company representatives on the telephone, I figured that Ryan and his firm had zero chance of getting me another penny. But hey, since he was willing, why not let him try?

Well, it took about 9 months of effort by Ryan and his team – yes, he did not give up fighting for me, even after I had said to him that he could give up at least 2 or 3 times. And amazingly, Ryan Wynne and his team was able to get the insurance company to agree on a settlement that netted me a payment of around $3,300.

I realize that does not sound like a lot of money. But for me, that $3,300 was totally found money – from the same insurance company that told me, in essence, to go pound sand. That surprise and welcome settlement helped me to pay off the rest of my car loan.

Therefore, if you are like so many other people, and you have no idea how to go about finding a personal injury law firm you can trust will work hard for you when you have been injured – then take it from me, and my personal experience. If you are located in Jupiter, Palm Beach Gardens, West Palm Beach, Stuart or anywhere else in south Florida, then Slinkman, Slinkman & Wynne is the personal injury attorney firm that will get you every penny that you deserve from your case – even if you are sure, like I was, that your insurance company or the party who caused your injury will never have to give you a penny. The lawyers at this firm understand personal injury law thoroughly, are hard-working, and willing to fight for you.

Go to our “Cases and Judgments” page to learn more about the many cases we have won fighting for our clients in a variety of personal injury cases, including automobile accidents, defective products, slip and fall, medical malpractice and others: http://www.sswlawfl.com/cases-judgments/.

Defective product update – U.S. sues Volkswagen over cheating emissions tests

As the Volkswagen auto emissions cheating scandal deepened throughout the end of 2015, the United States Justice Department decided to jump in and sue the beleaguered automobile company in the first week of January. When the scandal first broke in September, it was not known just how massive the number of cars involved was. Now it is estimated that Volkswagen engineers altered the software in more than 600,000 diesel engine cars that were sold here in the United States from 2009 through 2015.

According to multiple reports including the one posted on NBC News’ website, “The civil complaint against the German automaker, filed on behalf of the Environmental Protection Agency in U.S. District Court in Detroit, alleges the company illegally installed software designed to make its diesel engines pass federal emissions standards while undergoing laboratory testing. The vehicles then switched off those measures to boost performance in real-world driving conditions, resulting in greenhouse gas emissions up to 40 times greater than federal environmental standards.”

Volkswagen faces fines from the U.S. Justice Department that could reach up to $90 billion alone, significantly more than the $18 billion estimates discussed when the scandal first broke. Apparently the illegal software may have also been used in automobiles produced by Audi and Porsche, both of which are now owned by Volkswagen.

Obviously this is a defective (illegal) product on a massive scale. And unfortunately, companies like Volkswagen do try to cheat, lie and defraud both the government and the public on a regular basis. If you own one of these Volkswagen’s in question or suspect that you have purchased or come into contact with another defective product, then you may want to seek legal representation to find out your rights and if you deserve financial compensation.

The U.S. Department of Justice lawsuit is being filed in the Eastern District of Michigan and then transferred to Northern California, where class-action lawsuits against Volkswagen are already pending.
