Through our blog here at Slinkman, Slinkman & Wynne, P.A. we often talk about the needless tragedies caused by people who are texting or otherwise distracted while driving their vehicles. Distracted driving is leading directly to serious injuries and death on our roadways here in Jupiter, throughout Florida and the entire United States. April is Distracted Driver Awareness Month (National Safety Council). This is the perfect time to share some valuable tips on how you can minimize the risks of driving, and keeping your attention on your vehicle and what is going on around you on the roadway.

Here are the following steps you should be taking to avoid the dangers of driving:

  • Wear your seat belt.
  • Whenever you are going to drive, try to plan ahead and leave early if possible, giving yourself extra time to get to your destination.
    • Giving yourself extra time makes you less stressed – and also one less excuse for picking up the phone and texting or calling ahead to tell someone that you are running late.
  • Be careful and extra aware in work/construction zones.
    • Here in Florida, there are currently multiple construction zones at night along most of our major highways (particularly I-95). There is big risk involved for the workers who are often close to the moving vehicles. Be extra aware and cautious when you see workers and active construction going on.
  • Do not let yourself be distracted.
    • Do not text. Do not let passengers (especially children) distract your attention. Do not let animals distract you either. Any distraction can significantly delay your response time, which can be the difference between avoiding an accident and being involved in one. Your vehicle can turn into a dangerous projectile in less than a second.
  • Have a plan for any troubles that can happen during your trip.
    • If you are not prepared for your vehicle breaking down or having a flat tire, you will be at the mercy of local towing companies and random service companies that could take advantage of you and your situation.
  • Make sure your proof of insurance is up to date and easily accessible.
  • Create for yourself safe phone useage rules while driving. And do everything you can to stick to them.

Automobile accidents in U.S. in 2016 rise to their highest level since in 2007: 2-year increase most in over 50 years

In its annual report released last week, the National Safety Council announced that lower gas prices and distractions while driving (texting and drunk driving chief among them) helped lead to another significant rise in fatal auto accidents throughout the United States in 2016.

 

In the report released last Wednesday, the National Safety Council said that approximately 40,200 motor vehicle deaths occurred from January through December of 2016 – an increase of 6% from the same period in 2015, and 14% over the two years since 2014, the largest 2-year jump in over 50 years.

What changes in federal “personal injury” law could result from Donald Trump’s surprise victory combined with a Republican-controlled Congress

Almost three weeks have passed since Donald Trump surprisingly won enough electoral college votes to become the President-elect. In addition, the Republicans were able to keep control over both the United States House of Representatives and the U.S. Senate. As a result, a number of our clients, perspective clients and business partners have asked us what the effects could be on potential personal injury and malpractice victims in the future here in Palm Beach County and the Treasure Coast.

 

First of all, it is important to keep in mind that the majority of personal injury cases are governed by either local or state law, including automobile accidents, motorcycle accidents, boating accidents, slip and fall cases (under state premises law) and most malpractice cases. So much of what we have experienced in cases here in south Florida over the last 5 to 10 years will remain largely the same.

 

The potential change that we will watch for is in regards to “Tort Reform”. In fact, a Tort Reform bill known as The Fairness in Class Action Litigation and Furthering Asbestos Claim Transparency Act of 2016 passed the U.S. House of Representatives earlier this year before it got gridlocked in the Senate.

 

With Republican President Donald Trump combined with a Republican-controlled Congress and Trump’s ability to appoint at least one “conservative” judge to the Supreme Court thereby giving the Judiciary Branch a conservative majority as well, it could well present a perfect storm leading to Tort Reform with monetary damage caps and other laws and decisions that will hurt the injured.

 

We believe that all Americans need to keep a close watch on what bills get proposed over the next 2 years in Congress – and be willing to voice your opinion if there is a bill that goes against the protection of the rights of your fellow Americans when they have been wrongfully injured or killed.

Most people have a general idea of what the term “wrongful death” means. In layman’s terms, for someone to die a wrongful death a person’s death is unnaturally caused by another person’s negligence or during the act of another crime.

The following excerpt comes right from law.com:

Wrongful Death –

“the death of a human being as the result of a wrongful act of another person. Such wrongful acts include: negligence (like careless driving), an intentional attack such as assault and/or battery, a death in the course of another crime, vehicular manslaughter, manslaughter or murder. Wrongful death is the basis for a lawsuit (wrongful death action) against the party or parties who caused the death filed on behalf of the members of the family who have lost the company and support of the deceased. Thus, a child might be entitled to compensation for the personal loss of a father as well as the amount of financial support the child would have received from the now-dead parent while a minor, a wife would recover damages for loss of her husband’s love and companionship and a lifetime of expected support, while a parent would be limited to damages for loss of companionship but not support. A lawsuit for wrongful death may be filed by the executor or administrator of the estate of the deceased or by the individual beneficiaries (family members).”

The definition is straight-forward and relatively easy to understand. There are important explanations described in this definition, however that have direct implications for those who are left behind in the wake of a wrongful death.

  1. A child may be entitled to compensation for both the personal loss of a parent AND for the financial support he or she would have received while a minor (usually the age of 18, but can be deemed longer).
  2. A wife may be entitled to additional compensation for the loss of her husband’s love, companionship AND expected financial support.
  3. A parent is limited to damages for loss of companionship, but NOT for any financial support (accept in special cases where the child has already been established as the financial provider for the parents – and even this type of case has contingencies).
  4. A lawsuit for wrongful death maybe filed by a variety of entities involved:
    1. The individual beneficiaries
    2. The executor of the deceased’s estate
    3. The administrator of the deceased’s estate

The National Highway Traffic Safety Administration (NHTSA) has made protecting automobile drivers and owners their top priority. A significant part of that effort has including updating and enhancing its website and social media to make it more user-friendly.
