Slinkman, Slinkman & Wynne advice: what to do if your car breaks down this holiday weekend, or any other time

This coming weekend marks the 2nd of the three major holiday weekends of our summer season here in the United States – Independence Day. In fact, according to a recent survey by the travel organization AAA, over 44 million Americans are expected to travel this weekend, a record number for any holiday since the great recession almost a decade ago. Around 2 million of those travelers are expected to be Floridians, almost 5% of our nation’s total.

 

Therefore, with a number of our Jupiter, Palm Beach Gardens, West Palm Beach and Treasure Coast family and friends traveling this weekend (including a number of us here from the Slinkman, Slinkman & Wynne, P.A. law offices) we believe it is the perfect time to offer all of you some important rules for what to do if your car breaks down while you are traveling:

  • As soon as you sense there is a problem, turn on your hazard lights
  • If your car is still moving, try to steer to the right and pull over to the right shoulder as quickly but also safely as possible. If you are unable to get over to the right but there is an area available to stop your vehicle out of moving traffic in the median area, move your vehicle to that area.
  • Wherever your vehicle comes to a complete stop, fully activate your emergency brake. You want to make sure that your vehicle will not start rolling in either direction, which can happen on even a normal, almost imperceptible slope to your naked eye.
  • Call for help – if you do not know the local number for roadside assistance or for the local police, call 911.
  • Stay in your vehicle until traffic clears. For example, if the worst happens and your vehicle stalls on the highway in traffic, do not leave your vehicle until help arrives, no matter how long it takes.
  • Once you are able to exit your vehicle safely (if you are) pop your hood and leave it open to signal other drivers that your vehicle is broken down.
  • DO NOT try to make any repairs or checking under your car if you are on the side of busy roadway or still in the line of traffic. People have been seriously injured and even killed in such situations.
  • If you can, put out some type of flares or other safety devices that behind your vehicle that signal you are in distress and can not move. Put one about 10 feet behind the vehicle, and another about 200 feet behind.
  • Once you have done these things, walk as far away from oncoming traffic as possible to wait for help to come.

  6. Both driver and rider should wear well-made protective helmets.

However, we have seen the results of what riding without a helmet can do in an accident. A helmet can save you from severe brain damage and even death. It is your head, your brain and your life – protect it.
  7. You should also wear protective clothing.
    1. Protective clothing can significantly lessen the damage to your body, particularly to your skin.
  8. Stay out of the blind spots of automobile and truck drivers
    1. The biggest problem with weaving in and out of traffic when you are operating your motorcycle is that invariably you end up crossing into and out of blind spots. As a result you significantly raise the chance that someone will accidently move into your path from another lane.
  9. Always be aware of road hazards and obstructions

Follow up to last week’s blog re: the growing incidence and danger of prescription drugs causing DUI

In our last blog we discussed the growing epidemic of DUI (Driving Under the Influence of a controlled substance) related arrests here in south Florida and throughout our country being caused by prescription drugs. The Tiger Woods DUI case has shown a spotlight on a problem that law enforcement has become all-too familiar with in recent years: prescription drugs are often powerful, and can become just as dangerous as alcohol when a person uses them and then gets behind the wheel of their motor vehicle.

In fact, taking a prescription drug before driving can be even more dangerous than alcohol because the danger of mixing prescription drugs and motor vehicle operation has been much less discussed and spotlighted than its counterpart alcohol. Furthermore, as The Palm Beach Post writers Jorge Millan and John Pacenti highlighted in their article on this very subject in last Thursday’s edition of The Palm Beach Post:

“According to a 2015 study released by the Governors Highway Safety Association, about 43 percent of fatally injured drivers were found to have either prescription or illegal drugs in their system, compared with 37 percent of drivers who had consumed alcohol. In 2005, only 27 percent of fatally injured drivers showed evidence of drug use.

The American Automobile Association reports that “prescription drugs are the most prevalent of all drugs” found in fatally injured drivers (46.5 percent).”

Millan and Pacenti further pointed out that the danger of driving under the influence of prescription drugs is even more pronounced because many drivers are “unaware they are doing anything wrong by driving drugged.”

Prescription drug abuse continues to lead to more DUI arrests in Jupiter and throughout Florida

By now almost everyone in south Florida and throughout the rest of the country has heard about Tiger Woods’ DUI arrest here in Jupiter early Monday morning. As more details have come out about the arrest, one of Tiger’s own statements that has received attention has been his contention that he was actually not under the influence of alcohol, but of a combination of prescription drugs.

 

When most of us think of DUI – Driving Under the Influence, we think of alcohol, hard core drugs like cocaine. The truth is that prescription drugs make up a significant portion of DUI arrests. Although the exact percentages are not known due to a lack of specific statistics, a 2010 study showed that prescription drugs were the 2nd most abused drug before driving when a fatal accident was involved. Only marijuana usage was higher on that list, while driving under the influence of cocaine caused only 25% of the number of automobile accident fatalities as prescription drugs, according to that same study.

Memorial Day weekend: a fun-filled weekend, but also the most deadly of driving holidays

This coming weekend marks so many good things to all of us Americans – the unofficial beginning to summer, the end of the school year, and the fun and great food of backyard and beach BBQ’s with family and friends. Unfortunately, this weekend also holds one very dubious title: it is the most dangerous driving weekend of the year. According to the National Highway Traffic Safety Administration (NHTSA) More people are killed in motor vehicle accidents over the 3-day Memorial weekend here in Florida and around the United States, on average, than any other 3-day period on the calendar. That includes the 4th of July, Labor Day, Thanksgiving, Christmas and New Year’s weekends.

Earlier this very evening: “One person is injured after a crash involving a motorcycle and a truck near Loxahatchee Tuesday evening, according to Palm Beach County Fire Rescue.

First responders were called to the intersection of Northlake Boulevard and Hall Boulevard, just east of Seminole Pratt Whitney Road, where a motorcycle and a truck collided after 9 p.m. The crash caused a fire on at least one of the vehicles and one person was injured, according to fire rescue.

The unidentified person was flown by the the Trauma Hawk to a local hospital. The person’s condition is unknown at this time. It’s unclear if anyone else was injured in the crash.”

And this afternoon: “WEST PALM BEACH, FL (WFLX)  Palm Beach County Fire Rescue is on the scene of a fatal motorcycle accident near Military Trail and Okeechobee Blvd. in West Palm Beach.

According to Palm Beach County Fire Rescue PIO Capt. Don Delucia, one person has died.

The intersection is currently shut down and drivers are being diverted from the area.”

And just this past Sunday: “Two motorcyclists from Palm Beach County died Sunday afternoon after their motorcycle hit a truck.

The accident occurred on Southeast Dixie Highway at Southeast Winged Foot Drive, according to the Florida Highway Patrol.

Scot Brian Fertig, 58, of West Palm Beach, was southbound at 2:20 p.m. on Southeast Dixie Highway when he crossed into northbound traffic, hitting the front end of a Toyota Tundra truck driven by Jonathan Rivera, 22, of Hobe Sound.

Fertig and a passenger on the motorcycle, Dianne Denise Resinkoff, 42, of Lake Worth, both were pronounced dead at the scene.

Neither motorcyclist was wearing a helmet.”

April is Distracted Driver Awareness Month (National Safety Council). This is the perfect time to share some valuable tips on how you can minimize the risks of driving, and keeping your attention on your vehicle and what is going on around you on the roadway.

Here are the following steps you should be taking to avoid the dangers of driving:

  • Wear your seat belt.
  • Whenever you are going to drive, try to plan ahead and leave early if possible, giving yourself extra time to get to your destination.
