Slinkman, Slinkman & Wynne, P.A. safety – tips to keep you safe while operating or riding upon a motorcycle

Motorcycle riding on the open road

Summer is here – for motorcycle riders, that means heading out on the open road to quench their thirst for the excitement and freedom that comes along with driving their motorcycles. At Slinkman, Slinkman & Wynne, P.A. we understand the lure of motorcycles for those who love them. We also realize that motorcycle driving can be very dangerous, particularly on the crowded highways here in south Florida.

With that in mind, we offer a list of tips for safe motorcycle driving and riding:

  1. Drive defensively
    1. Bad automobile drivers cause accidents with motorcycles; but so too do bad motorcycle drivers themselves. Aggressively operating a motorcycle causes a significant number of motorcycle accidents, as well.
  2. Do NOT drink and operate or ride on a motorcycle
    1. In a study cited in an article on motorcyclecruiser.com, the California Highway Patrol found that 69 percent of all at-fault motorcycle collisions happened when the rider was “under the influence” of drugs or alcohol.
  3. Follow the rules of the road
    1. Piggybacking on tip #2, following the rules of the road gives you a much better chance of getting back home safe and sound.
  4. Consistently check your motorcycle, particularly after longer rides, to make sure it is in proper working condition.
  5. If you have not done so already, take a motorcycle safety course.
  6. Both driver and rider should wear well-made protective helmets.
    1. Yes, we realize that here in Florida by law you can operate or ride on a motorcycle without a helmet or protective headgear. However, we have seen the results of what riding without a helmet can do in an accident. A helmet can save you from severe brain damage and even death. It is your head, your brain and your life – protect it.
  7. You should also wear protective clothing.
    1. Protective clothing can significantly lessen the damage to your body, particularly to your skin.
  8. Stay out of the blind spots of automobile and truck drivers
    1. The biggest problem with weaving in and out of traffic when you are operating your motorcycle is that invariably you end up crossing into and out of blind spots. As a result you significantly raise the chance that someone will accidently move into your path from another lane.
  9. Always be aware of road hazards and obstructions

Motorcycle accidents hurt and kill thousands of people in Florida every year

Motorcycle accident picture

The reports come in all-too-frequently here in Jupiter, Palm Beach Gardens, West Palm Beach, Stuart and practically every city and town throughout south Florida and beyond:

Earlier this very evening: “One person is injured after a crash involving a motorcycle and a truck near Loxahatchee Tuesday evening, according to Palm Beach County Fire Rescue.

First responders were called to the intersection of Northlake Boulevard and Hall Boulevard, just east of Seminole Pratt Whitney Road, where a motorcycle and a truck collided after 9 p.m. The crash caused a fire on at least one of the vehicles and one person was injured, according to fire rescue.

The unidentified person was flown by the the Trauma Hawk to a local hospital. The person’s condition is unknown at this time. It’s unclear if anyone else was injured in the crash.”

And this afternoon: “WEST PALM BEACH, FL (WFLX)  Palm Beach County Fire Rescue is on the scene of a fatal motorcycle accident near Military Trail and Okeechobee Blvd. in West Palm Beach.

According to Palm Beach County Fire Rescue PIO Capt. Don Delucia, one person has died.

The intersection is currently shut down and drivers are being diverted from the area.”

And just this past Sunday: “Two motorcyclists from Palm Beach County died Sunday afternoon after their motorcycle hit a truck.

The accident occurred on Southeast Dixie Highway at Southeast Winged Foot Drive, according to the Florida Highway Patrol.

Scot Brian Fertig, 58, of West Palm Beach, was southbound at 2:20 p.m. on Southeast Dixie Highway when he crossed into northbound traffic, hitting the front end of a Toyota Tundra truck driven by Jonathan Rivera, 22, of Hobe Sound.

Fertig and a passenger on the motorcycle, Dianne Denise Resinkoff, 42, of Lake Worth, both were pronounced dead at the scene.

Neither motorcyclist was wearing a helmet.”

Unfortunately, if you are involved in a motorcycle accident, there is a good chance you will suffer significant injury, and possibly even die. According to statistics compiled by state and federal highway authorities, Florida continues to lead nation in motorcycle accidents on a yearly basis. In fact, almost 1 in 10 of the almost 5,000 fatalities from motorcycle accidents in the entire United States occur right here in Florida. On top of that, almost 10,000 were injured – many seriously – in our state alone.

At, Slinkman, Slinkman & Wynne P.A. we have over four decades of experience working with clients who have been involved in motorcycle accidents causing serious injury and death. We strongly believe in helping to promote motorcycle safety in our communities here in Jupiter, Palm Beach Gardens, West Palm Beach, Stuart as well as throughout the state of Florida.

If you or anyone you know has been injured in a motorcycle accident, our Palm Beach Gardens Injury Attorneys are here to help.  The reality is…if you’re a Florida biker living in the Palm Beaches, it’s not a matter of if you’ll be involved in an accident, but most likely when. Knowing the right (and wrong) things to do at the scene can be critical to ensuring your immediate legal and financial protection as well as your physical and emotional well-being down the road. That’s where we come in.

Slinkman, Slinkman & Wynne safety tips: driving during school days in Florida

school bus unloading

The middle of August here in Florida means several things: the summer season weather-wise (hot and humid) is about half over, but more importantly, schools are back in full swing. Even if you do not have any children that are school-age, you know school is back in session with the significant pick up in traffic and congestion on the roadways as you try to make your way to and from work. That also means you must be significantly more careful where ever you are driving at this time of year.

Therefore, we will do a 2-part blog on driver safety during school days. This first part is a refresher of general driving safety tips for all drivers at this time of year to help keep kids, other drivers and yourself accident and injury-free during school days. In the second part we will share with you some safety tips for parents and others driving kids to and from school:

  • Plan to leave your home a few minutes earlier than you did during the summer to get to your destination.
    • Between school buses, kids walking and on bikes, and parents trying to drop off or pick up their kids, traffic congestion is significantly more than it was just two weeks ago. Adjust for that so you keep yourself from getting frustrated, angry and impatient behind the wheel.
  • Slow down and pay attention to the road AND the surrounding sidewalks
    • Even the safest of drivers can not predict a child darting out into the middle of the road apparently out of nowhere. The slower you are driving, the more time you will have to react when unexpected, potentially dangerous actions by others, particularly kids, happen.
  • Do NOT pass a bus that has its “Stop Sign” and blinkers on. Ever.
    • Of course we all have had that morning we are running late, and then we get stuck behind a school bus stopped to pick up kids… and it is taking forever. There is no one on the other side of the road, and it looks so tempting to go around the bus and continue on your way. Don’t do it. The leading cause of death among kids and teenagers is accidents/unintentional death, according to https://medlineplus.gov/ency/article/001915.htm

Boating and Jet skiing accidents increase in Florida in 2015

Jet skiing is one of the most popular shoreline activities to do here in Florida. Flying along across the waves can be incredibly fun and exhilarating – and also quite dangerous. The uneven, rocky shoreline in many areas, combined with our notorious rip currents (currents that flow away from shore) can cause problems for even the most experienced of jet skiers in our area.

This now-famous video posted on YouTube captures a jet ski crash that occurred along the Newport Beach, California coastline in June. Although this happened in California, jet ski accidents like this can and do happen here in Florida, as well.

In fact, according to the Florida Fish and Wildlife Conservation Commission,  Florida had 737 boating accidents in total in 2015, which includes jet ski and wave runner accidents. That is 103 more accidents as compared to 2014, however, there was a 25 percent decrease in fatalities. A total of 55 people lost their lives last year in boating accidents.

How to spot a drunk driver in Jupiter and Palm Beach Gardens

Summer is here which also means the summer driving season is here. Many families pack up their belongings and the children and head to points all over the United States to visit friends and relatives. Of course there are also 3 major holidays that happen during this time, as well. Memorial Day has come and gone, while Independence Day is only a few weeks away with Labor Day to follow at the beginning of September.

Statistics tell us that the incidence of drunk driving rises significantly on and around these holidays. In fact, July 4th and Labor Day turn out to be two of the three or four days with the most drunk driving deaths in America every year, according to yearly surveys by the National Highway Traffic Safety Administration (NHTSA).

With that in mind here are ways for you to spot a drunk driver out on the road during this time, and any time. Spotting a drunk driver in enough time to get away may just save your life, and the life of your family.

From MADD: “While we work hard to turn cars into the cure and eliminate drunk driving forever, families must continue to be vigilant on our roadways.  You can help protect your family from drunk drivers by looking for these signs of intoxication among other motorists.” This full list is shared directly from the Mothers Against Drunk Driving (MADD) website:

  1. Quick acceleration or deceleration
  2. Tailgating
  3. Weaving or zig-zagging across the road
  4. Driving anywhere other than on a road designated for vehicles
  5. Almost striking an object, curb, or vehicle
  6. Stopping without cause or erratic braking
  7. Drifting in and out of traffic lanes
  8. Signaling that is inconsistent with driving actions
  9. Slow response to traffic signals (e.g. sudden stop or delayed start)
  10. Straddling the center lane marker
  11. Driving with headlights off at night
  12. Swerving
  13. Driving slower than 10 mph below the speed limit
  14. Turning abruptly or illegally
  15. Driving into opposing traffic on the wrong side of the road

Tips for safe boating during the summer season in Florida

Family in Life jackets on a boat on a lake

Memorial Day weekend has come and gone, and schools are on summer vacation. The summer boating season has begun. Now is a great time to remind all of you out there who plan on boating this summer here in Jupiter, Palm Beach Gardens and throughout south Florida of some important boating safety tips to help keep you, your family and friends healthy and happy out on the open water this year.

Here is a list of 8 boating safety tips that you, your family should follow each and every time you go out on a boat here in south Florida at this time of year:

  1. Do not drink if you are driving or planning to drive the boat. First of all, it is just as illegal to drink and drive a boat as it is an automobile or motorcycle. Furthermore, drinking dulls your senses, greatly increases your response time if something happens. And boats do not maneuver as fast as cars to begin with. Leave the drinking for later.
  2. Check the weather before you go – have an idea what is supposed to happen throughout the time you are out on the ocean. People who have lived here a while already know this, but the summer season on the east coast of Florida sees many afternoon rain storms that also go out over the Atlantic Ocean. If you are unaware or not paying attention, you can be caught in a dangerous rain squall in a relatively short amount of time.
  3. Make a “float plan” and share it with someone. Let at least one other person (several, optimally) know of your travel plans for that day. Include your name, address, phone number, make and model of the boat, departure and arrival time and any stops you are planning along the way.

** There are mobile phone apps available for just this purpose. Here is a list of a few of them from Discover Boating.com:

http://www.discoverboating.com/appsandtools.aspx?c=681

  1. Check the boat for sea-worthiness before putting it in the water. The middle of the ocean is no place to figure out that your boat has a problem that you could have detected before leaving.
  2. Make sure you have all the proper safety equipment onboard. In addition to having and wearing life jackets, make sure to carry at least the minimum required equipment by the U.S. Coast Guard. Here is a list, depending upon the length of your boat: http://www.boatus.org/guide/equipment_6.html
  3. Once onboard, wear a properly fitting life jacket; make sure to outfit any children with life jackets as well. The United States Coast Guard recently released estimates stating that over 80% of the people who died in boating accidents could have been saved if they had been wearing a life jacket.
  4. Ensure the safety of every child on board your boat:
    1. Make sure they have a life vest made for their size
    2. Teach them not to run around the boat; to stay seated while the boat is moving, and to keep their hands and feet inside the boat at all times
    3. If they are your children and you plan on having them out on the water with any consistency, have them enrolled in swimming and boater safety classes.
  5.  Watch for swimmers and other smaller water craft. You are in control of a vehicle that can turn into a deadly weapon very easily. You can neither slow down, reverse or maneuver anywhere near as quickly as you can when manning most other types of vehicles, particularly in the canals and Intracoastal Waterway areas. Therefore, you need to anticipate what moves anyone else within your vicinity might make at least 8 to 10 seconds in advance, if possible.

Car seat laws improved but need to go further in Florida to protect more of our children

Beautiful happy girl with teddy bear sleeping in the car

Schools across the state of Florida are letting out for summer break this coming week. That means that the summer driving season is upon us, where families will be driving around the state of Florida and to much more far-flung places around the country to visit relatives, friends and the multitude of tourist attractions that this great country of ours has to offer. Now is the perfect time to remind all of you who will be traveling this summer Florida’s most up-to-date car seat and restraint laws for children.

The most recent changes went into effect about a year and a half ago, on January 1st, 2015. Here is a quick refresher of the series of requirements, as stated in the 2015 Florida Statutes:

  • Children through the age of 3 must be secured in a federally-approved car restraint seat.
  • Children through the ages of 4 and 5 must be secured in a car seat or booster seat. Which one depends upon their size.

http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0316/Sections/0316.613.html

These additions to the state law increased requirements up through the age of 5. Before the beginning of last year, car seat requirements for children in the state of Florida only covered up through the age of 3. Although this is certainly an improvement, a number of child safety advocates continue to lobby for Florida state politicians to bring our laws in line with other states or to the standards recommended by the American Academy of Pediatrics’ that children by restrained in a booster seat until they are at least 4 feet, 9 inches (57 inches) tall.

St. Joseph’s Children’s Hospital child advocacy supervisor Bevin Maynard was quoted as saying by the Tampa Bay Times that the magic number “is not weight or age. It is height.”

She has had quite a bit of experience working with children and their families when a child has been seriously injured in an automobile accident. She knows that statistics from the National Highway Traffic Safety Administration state that the leading cause of death for children between the ages of 5 and 14 in the United States is improper restraint when in a traffic accident.

Some information for this blog post including the quote from Bevin Maynard was shared from the following article:  http://www.tbo.com/news/politics/new-florida-car-seat-law-takes-effect-jan-1-20141221/

Teens still need to be pushed to wear their seat belts in cars in Jupiter, Palm Beach Gardens and everywhere else in America

Safety: Female Driver Fastening Seat Belt

Even with the additional emphasis by practically everyone – the media, automobile companies, the government (through their “Click It or Ticket” campaign) and even society in general – the percentage of teenagers who drive without wearing their seatbelts has remained largely unchanged over the last decade and a half. That according to statistics published by the CDC (Centers for Disease Control and Prevention).

Approximately 20% do not wear their seat belt now, or 15 years ago; the percentage of male teen drivers not wearing seat belts is still about 10% higher than female teen drivers; and the percentage of teens who died in motor vehicle accidents who were not wearing their seat belt still hovers around 50%. To read more on these sobering and sad statistics, please go to the following articles:

http://www.cdc.gov/motorvehiclesafety/teen_drivers/teendrivers_factsheet.html

and

http://www.gallup.com/poll/6145/teens-buckling-up.aspx

Advocates of increasing teenage driver safety point to driving programs that “Driving programs that combine education, peer-to-peer strategies, publicized enforcement, and parental monitoring may show potential for increasing teen seat belt use.” – See more at:

http://www.teendriversource.org/stats/support_teens/detail/59#sthash.0KQmDMyw.dpuf

At Slinkman, Slinkman & Wynne, P.A. we agree that driving programs that emphasize better education combined with stricter laws for those who refuse to wear seat belts could work to lower the numbers of teenager injuries and deaths in auto accidents. Ultimately, though, the greatest effect can most likely come from responsible parents, and peers who help to make wearing seat belts fashionable, and a must for all teenagers. WE applaud websites like the CDC and Teen Driver Source that are pushing every day to educate teenagers and their parents on the dangers of not wearing seat belts.

If you are injured in an auto accident because you or someone you love was not wearing a seat belt, you may have a right to bring a claim for various damages and injuries incurred. Call us at Slinkman, Slinkman & Wynne. We offer a free initial consultation, and our phone number is (561) 686-3400.

At Slinkman, Slinkman, & Wynne, we know that automobile accidents involving people not wearing their seat belts happen all of the time. Texting & Driving: a preventable cause of too many deaths and injuries on Florida roadways

Stop Texting While Driving Sign

The time has come. In fact, it has long since passed. And now we have another year’s worth of statistical data that shows beyond a shadow of a doubt that we need more of a deterrent to stop texting and driving – and most other forms of cellphone usage while operating a motor vehicle.

In the state of Florida in 2015 alone 214 people were killed in accidents caused by “distracted driving.” An astounding 39,396… yes, over 39,000! Were injured. We ask every single citizen of this state – when is enough enough? How many more lives need to be lost or forever changed for the negative because of someone else’s negligence?

The fact is that our states’ laws against texting and driving, and cellphone usage while driving in general are some of the most lax in the entire country. For example, texting while driving is still considered a “secondary” offense here in Florida. A secondary offense means that you must get pulled over for committing some other offense before you get cited for texting while driving as well.

How many more lives will be lost needlessly and carelessly before we as a state get serious about curbing “distracted driving”? Our drinking and driving laws have become significantly more costly – in both money and freedoms taken away – than they were just a few short years ago. The same needs to happen with Florida’s texting and driving laws, as well.

Here are several websites we have mentioned before, such as http://www.textinganddrivingsafety.com/ and https://noys.org/ to see what you can do to help spread the word on curtailing texting and driving with teenage drivers, and all other drivers.

If you are injured in an auto accident because the other driver was texting, you may have a right to bring a claim for various damages and injuries incurred. Call us at Slinkman, Slinkman & Wynne, P.A. We offer a free initial consultation, and our phone number is (561) 686-3400.

At Slinkman, Slinkman, & Wynne, we know that automobile accidents involving cell phone usage happen all the time now, unfortunately. If you are in an accident because of the willful negligence of another driver then you need to contact us right away. Required personal injury protection benefits in Florida – what they mean to you as a Florida resident

Personal Injury Claim

Most people who live here in Florida are aware that the state has a series of laws called the Florida Statutes that are “a permanent collection of state laws organized by subject area into a code made up of titles, chapters, parts, and sections. The Florida Statutes are updated annually by laws that create, amend, transfer, or repeal statutory material.”

http://www.leg.state.fl.us/Statutes/index.cfm?Mode=View%20Statutes&Submenu=1&Tab=statutes

Included amongst the 2015 Florida Statutes is an entire section on Insurance: Title XXXVII, Chapters 624 through 651. Chapter 627 of this section covers Insurance Rates and Contracts. 627.736 refers to “Required personal injury protection benefits; exclusions; priority; claims”

At Slinkman, Slinkman & Wynne, P.A. we realize that most Florida residents reading this blog do not want to read through the rather complicated and long-winded statutes that discuss insurance requirements. You want to know what they are and how they affect you and your loved ones, in plain English.

Since the last changes to the statutes in 2012 & 2013, Florida drivers have been required to carry the following minimum insurances:

  • $10,000 in personal injury protection (PIP) benefits, and
  • $10,000 in property damage liability (PDL) benefits.

Florida does not, however, require drivers to have bodily injury liability (BIL) benefits (which pay the costs of others’ injuries if a crash occurs). Most other states do require you to have BIL benefits in your insurance coverage. All auto insurance policies must be purchased from insurers licensed to do business in Florida. Driving without insurance in Florida is illegal, and a driver may have his or her license suspended if caught driving without at least the minimum required insurance. To get a license reinstated, a driver has to show proof of insurance on every vehicle owned in the state of Florida, and must pay a fine of up to $500 per violation.

These are just the basic rules of insurance as they are presently constituted here in Florida. Our Board Certified lawyers from Slinkman, Slinkman, & Wynne are the right lawyers to get you the best settlement that you deserve based upon your unique set of circumstances when you have been involved in an automobile accident.  We will find out what coverage you and all of the motorists involved in the accident have – making sure to ask all of the right questions of all companies and interested parties in your case.

If a person you care about gets hurt or killed in a car, motorcycle or boating accident, or you simply have a question about a potential personal injury situation that you have not yet had answered, please call us at Slinkman, Slinkman & Wynne, P.A. We offer a free initial consultation, and our phone number is (561) 686-3400.
