How long do I have to file a personal injury lawsuit in the state of Florida?

Like every other state in America, Florida has a law in its statutes that specifically sets a deadline for the amount of time you have to file a lawsuit in our state’s civil courts against the person or business that might be legally at fault for your injuries caused in an accident. This law is called a statute of limitations, and in Florida law this statute can be found in the Florida Statutes Annotated section 95.11.

 

The most important aspect of the statute of limitations for you if you are injured in an accident is that it gives you four (4) years from the date of the accident to file a lawsuit. Otherwise, unless under extreme and very rare cases, the court will almost certainly refuse to even hear your case at all.

 

One important adjunct to the Florida statute of limitations law is that if your injury claims are against either a city, county or state government entity or official your time limit to file is only three (3) years.

Easy-to-follow guide for safe and stress-free holiday light hanging from Slinkman, Slinkman & Wynne, P.A.

Thanksgiving is in the rearview mirror and we are now officially in the middle of the holiday season. Across Jupiter just like the rest of Florida and the United States people of all ages are decorating their houses with trees, candles, ornaments and of course, lights. Stringing up the lights around your home can be one of the most entertaining activities of your holiday prep work. Particularly here in Florida, where we can sit outside all night and enjoy the light show without freezing half to death.

Unfortunately, it can also be one of the most dangerous.

In order to help you string up your lights as stress-free and safe as possible, here is a step-by-step guide for hanging your holiday lights by Yourself (or with a helper). Make special note that THE FIRST 5 STEPS happen BEFORE you begin the actual work of stringing!

  1. Preparation: Make sure you have assembled the proper tools and materials. Whether you are putting up lights only, or adding in all kinds of extra decorations, having the proper tools to do the job is important. Unfurl the lights and check them to ensure each and every bulb is working. Have extension cords, your hanging tools (clips, adhesive hooks and light-hanging pole) and ladder (if needed) laid out for easy access. We also recommend that you have some sort of timer so that you do not have to worry about turning the lights on and then off yourself every day and night.
  2. Figure out the best lights for your job: better to do this before you start. There are many different types of holiday lighting out there, and it is a good idea if you evaluate the different types and pick the best ones for your home before you start stringing.
  3. Measure: Always measure the areas where you are putting up your lights. You will find it virtually impossible to know how many strands of lights you will need to adequately complete the job without measuring your surface area first.
  4. Evaluate the surfaces you will be securing the lights to: When you think about it, rarely will you be securing the lights to just one surface. There are the roof tiles, gutters, siding/shingles, porches, poles, doors, windows and other surfaces. All of them can have different types of clips. Be forearmed with this knowledge when you are going to purchase the lights so the expert in the hardware store can tell you exactly which type of clip is best for which surface.
  5. Power: How will the lights be connected to your power source, and how much power will they need: This one seems simple enough, but can turn what looks like a straight-forward job into a complicated mess. You want to calculate the power usage because you want to prevent overloading your circuits or blowing a fuse. Just ask Clark Griswold what can happen when you “wing it”.
  6. Stringing: If you have correctly and patiently gone through the first 5 steps, this step should be relatively straight-forward. Of course if you are having to go up high enough that there will be ladders involved, then you should have a spotter if at all possible. Even the most secure ladder can slip or tip over. And chances are you will get injured, maybe quite seriously, if you fall. It is not worth not asking for help.
  7. Turn on the lights and Enjoy (hopefully)! Now comes the time to enjoy the fruits of your labor. If there are any lights not working, re-checking them to make sure they are screwed in correctly. If they are and still not working, then replace them. Put the lights on the timer, and now you get to enjoy your beautiful display every night during the holiday season!

How do you go about picking a personal injury attorney when you need one? So many of us are afraid that after you get past the television commercials and the hype, most personal injury law firms are little more than uncaring “ambulance chasers”, just looking for their next big score, whether or not you have a legitimate personal injury case or not.

 

Here is a story that proves beyond a shadow of a doubt that attorneys and staff at Slinkman, Slinkman & Wynne, P.A. are not your typical personal injury law firm personnel. How do I know this? Because I have been a client of theirs. During the late afternoon/early evening of a Monday in April of last year (2015), I was involved in 2-car automobile accident on I-95 in West Palm Beach. During the weeks that ensued I would come to learn that my automobile insurance company of 25 years valued my car at almost $5,500 less than I owed on my loan (despite the fact I purchased it used, two years old), AND they would only cover 5% of the cost of my visit to my local MDNow to have my neck checked out – an additional loss of $525 for me. Since I had only owned the car for 10 months, I argued with my insurance company that they had covered the car for the full value of what I purchased it for, and I could not understand how they now valued it for $8,000 less than my purchase amount in less than a year.

 

Suffice it to say – the multiple debates accomplished nothing other than to make me extremely frustrated. Particularly since I have been a loyal customer for all of those 25 years, involved in only one accident since my early college days. Conservatively they have made at least $20,000 on me over that time.

 

When I related my story to Slinkman, Slinkman & Wynne, P.A. partner Ryan Wynne at a networking event, he asked me if I were willing to allow him to work on my behalf to try and recover some of the money I had lost. Honestly, I had given up. After hours of useless arguing with multiple insurance company representatives on the telephone, I figured that Ryan and his firm had zero chance of getting me another penny. But hey, since he was willing, why not let him try?

 

Well, it took about 9 months of effort by Ryan and his team – yes, he did not give up fighting for me, even after I had said to him that he could give up at least 2 or 3 times. I realize that does not sound like a lot of money. But for me, that $3,300 was totally found money – from the same insurance company that told me, in essence, to go pound sand. That surprise and welcome settlement helped me to pay off the rest of my car loan.

The air filled with sounds of laughter and reverie.

 

It is a night where all of us driving our automobiles need to be extra careful. Here are a few safety tips from all of us at Slinkman, Slinkman & Wynne, P.A. to help you and your neighbors stay safe tomorrow night:

 

  • Drive slowly, especially in any residential area – Better that you are a minute or two late than involved in a tragic accident with a pedestrian.
  • Stay off your mobile phone – Try extra hard to avoid distractions on Halloween night. Children walking on the sides of the road can be unpredictable at normal times, and especially so when caught up in the excitement of trick-or-treating.
  • Keep your eye out for children darting out into the street – The last point leads us right into this one. Be extra watchful of kids running out unexpectedly into the road.
    • Some costumes limit a child’s visibility, so they might end up walking out into the road without even realizing they have done so.
  • Turn your headlights on earlier than usual – make yourself as visible as possible.
  • Do not pass stopped vehicles – A stopped vehicle could be dropping off trick-or-treaters. Take time to assess the situation and make sure there are no children around the stopped car before proceeding.
  • Always yield to the children crossing the street, even if they are not in a cross walk. They may not see you, or they may not have been taught how to correctly cross a street. Either way, you can take it upon yourself to be cautious and safe, no matter what the younger pedestrians are doing Halloween night.

Sobering news: NSC announces that automobile deaths in first half of 2016 increase 43% in state of Florida

In its semi-annual report released recently, the National Safety Council announced that distractions while driving combined with lower once again were the leading causes in another significant rise in fatal auto accidents throughout the United States in the first six months of 2016. In the report, the National Safety Council said that approximately 19,100 motor vehicle deaths occurred from January through June of this year – an increase of 9% from the same period in 2015. That also puts the U.S. on pace to have more than 40,000 automobile accident fatalities by the end of the year; the first time we have exceeded that number since 2007.

Even worse for us Floridians, that same report also stated that driving-related deaths in Florida were up a whopping 43% over last year. This jump comes on the back of significant increases in both 2015 and 2014. Florida was one of only three states to have more than 1,000 deaths in the first half of the year, and has the 5th largest increase of any state in the country. Only Vermont, Oregon New Hampshire and Idaho have seen a higher rate of increase in the death rate.

Boating and Jet skiing accidents increase in Florida in 2015

Jet skiing is one of the most popular shoreline activities to do here in Florida. Flying along across the waves can be incredibly fun and exhilarating – and also quite dangerous. The uneven, rocky shoreline in many areas, combined with our notorious rip currents (currents that flow away from shore) can cause problems for even the most experienced of jet skiers in our area.

 

This now-famous video posted on YouTube captures a jet ski crash that occurred along the Newport Beach, California coastline in June. Although this happened in California, jet ski accidents like this can and do happen here in Florida, as well.

In fact, according to the Florida Fish and Wildlife Conservation Commission,  Florida had 737 boating accidents in total in 2015, which includes jet ski and wave runner accidents. That is 103 more accidents as compared to 2014, however, there was a 25 percent decrease in fatalities. A total of 55 people lost their lives last year in boating accidents.
